RE:
Coppell Crossing; Request for permission to commence steel construction prior to
completion of concrete; Request that as-built drawings delivered to City exclude a
reproducible copy
Gentlemen:
This law firm represents Mockingbird Management Company and the Coppell Crossing
Limited Partnerships. By this letter, formal written request is made to allow my client to commence
steel construction prior to completion of fire lanes and parking lots and to request that my client not
be required to deliver a reproducible copy of the as-built drawings.
It is my understanding that the theory behind the City's requirement that all paving areas be
completed prior to commencing steel construction is for the fighting of fires. We would request an
exception based upon the following. The area to be paved is very large and will surround two

buildings to be built. My client proposes that it be allowed to frame the building using the columns,
beams, and girders (all made of steel) concurrent with the ongoing utility work. My client will
maintain an earthen fire lane at all times during this process pending completion of the poured
concrete fire lane and parking lot. When the utility contractors are out of the way, the parking lot
and fire lanes would be poured and completed prior to exterior gyprock rock and prior to any
masonry put on the buildings.
With respect to as-built drawings, my client does not want to facilitate a third party having
such easy access to the proprietary trade secrets contained within such as-built drawings. My client
has no problem in delivering as-built drawings to the City; however, it is my client's formal request
that the requirement to deliver reproducible as-built drawings be waived.
Thank you for your attention to this matter. Please do not hesitate to contact the undersigned
or Mitchell Vexler at 940-241-2353 if you have any questions with regard to the matters raised by
this correspondence.
