reconstruction of the driveway to Coppell Middle School west on Wrangler
Drive; and authorizing the Mayor to sign.

The execution of this interlocal agreement by the City of Coppell and the CISD will require the
CISD to pay for the cost of the reconstruction of the driveway located at the northeast comer of
the Coppell Middle School west property on Wrangler Drive. During the design phase of the
Wrangler Drive Street Reconstruction Project, staff met with representatives from CISD to
discuss the alignment of the driveways at Coppell Middle School West. Since the driveway
located at the northeast comer of the school property is used as the main drop-off, the school
district felt it would be a good idea to construct a divided driveway where it connects to
Wrangler Drive (see exhibit).
Since the driveway reconstruction is offsite of the project, the CISD would be responsible for the
cost of the driveway reconstruction in the amount of $12,387.
Staff recommends approval of the interlocal agreement between the City of Coppell and the
Coppell Independent School District. Staff will be available to answer any questions at the
Council meeting.

INTERLOCAL COOPERATION AGREEMENT
This Interlocal Cooperation Agreement is made by and between the City of Coppell,
Texas (hereina~er referred to as "the City") and the Coppell Independent School District
(hereinafter referred to as "CISD").
RECITALS:
WHEREAS, the City of Coppell, Texas, a home rule municipality, hereinaf~er called
"City" and the Coppell Independent School District, hereinat'ter called "CISD" desire to enter into
an agreement whereby the City will construct driveway improvements at the northeast comer of
the Coppell Middle School West property located on Wrangler Road and the CISD will pay the
City its share of the costs of the construction.
WHEREAS, Chapter 791 of the Texas Government Code, as amended, provides
authorization for local governments to enter into interlocal contracts; and
WHEREAS, this interlocal contract is mutually advantageous for both the City and CISD
and has been authorized by their goveming bodies; and
WHEREAS, the payments for the performance of governmental functions and/or services
set out herein will be made from current revenues available to the City and CISD.
NOW, THEREFORE, in consideration of the foregoing and other valuable
consideration, the receipt and sufficiency of which are hereby acknowledged, the City and CISD
agree as follows:
I.
CISD agrees to pay the City for its share of the costs to construct the driveway
improvements at the northeast comer of the Coppell Middle School West property located on
Wrangler Road. CISD's share of the cost is estimated at $12,387.00, as set forth in Exhibit "A".
CISD agrees to escrow the sum of $12,387.00 at the time of its execution of this agreement and
to remit a check payable to the City in said amount or to provide the City with an irrevocable
letter of credit in said amount acceptable to the City, prior to the start of the construction. In the
event CISD's actual share of the costs of construction exceeds the sum of $12,387.00, the City
will provide CISD with written notification of the additional costs and CISD will pay said costs
after obtaining approval for the additional funding. CISD shall pay the additional costs to the City
within forty-five (45) days after receipt of the written notification from the City for said costs. In

the event CISD's actual share of the costs of construction is less than $12,387.00, the City will
refund the difference in costs to CISD within thirty (30) days aRer completion and approval of the
construction.
This Agreement shall be binding upon and inure to the benefit of the parties hereto and
their respective successors and assigns.
HI.
No amendment, modification or alteration of the terms hereof shall be binding unless the
same be in writing, dated subsequent to the date of this Agreement and duly executed by the
parties.
IV.
The obligations and undertakings of each of the parties of this Agreement are and shall be
performed in Dallas County, Texas. The validity of the Agreement and any of its terms or
provisions, as well as the rights and duties of the parties, shall be governed by the law of the State
of Texas; and venue for any action conceming this Agreement shall be in Dallas County, Texas.
V.
The parties to this Agreement represent that they have full capacity and authority to grant
all rights and assume all obligations that they have granted and assumed in this Agreement.
VI.
This Agreement may be terminated by either party by providing the other party with thirty
(30) days prior written notice of termination.
VII.
The recitals to this Agreement are incorporated herein by reference.
