HalffAssociates, Inc. (Haiti) is pleased to submit the following jurisdictional determination and Section
404 permitting assessment for an unnamed tributary of Denton Creek in Lewisville, Texas. The tributary
is located east of Ridgemont Drive and perpendicular to State Highway (SH) 121 Bypass in southeast
Denton County.
BACKGROUND INFORMATION
Prior to site investigation, USGS topographic maps, USFWS National Wetlands Inventory (NWl) maps,
soil survey maps, and aerial photographs were used as aids in determining the jurisdictional status of the
unnamed tributary of Denton Creek. The USGS topographic map depicts the creek flowing north to south
into Denton Creek approximately 2,500 feet east of Denton Tap Road. SH 121 Bypass and Ridgemont
Drive are not shown. The topography is gently to moderately sloping and drainage is toward the south.
The USFWS NWl map was reviewed to bring special attention to potential wetlands associated with the
unnamed tributary of Denton Creek. Neither the tributary nor any adjacent wetlands were identified on
the NWl map.
Soil units as mapped by the Soil Survey of Denton County, Texas (1980) include Bastrop fine sandy loam
- 1 to 3 percent slopes, Bastrop fine sandy loam -3 to 5 percent slopes, Ferris-Heiden clays - 5 to 15
percent slopes, Frio silty clay - occasionally flooded, Ponder loam - 1 to 3 percent slopes, and Trinity
clay - occasionally flooded. None of the soil units is listed on the local hydric soils list. The unnamed
tributary of Denton Creek is shown on Soil Survey aerial photography (1975).
FIELD INVESTIGATION
On October 5, 2001 Halff conducted a site investigation to verify the limits of jurisdictional wetlands and
waters of the U.S. The site investigation was limited to the area between the eastbound and westbound
SH 121 Bypass frontage roads and areas immediately upstream and downstream. The entire area
surveyed has been channelized and is maintained via regular mowing. An on-channel concrete flume is
present north of the westbound frontage road. Although the tributary within the surveyed area has been
channelized, there is an evident ordinary high water mark (ohwm) approximately 8 feet wide. Vegetation
within the ohwm was dominated by cattail (Typha spp.) and black willow (Salix nigra). Vegetation on
the side slopes of the channelized area consisted ora mixture of native upland grasses and wildflowers.

PERMITTING ASSESSMENT
Nationwide Permit 14 -Linear Transportation Crossings authorizes discharges of dredged or fill material
into non-tidal waters of the U.S. necessary for the construction, expansion, modification, or improvement
of linear transportation crossings, provided the activity does not cause the loss of greater than one-half
acre of waters of the U.S. Furthermore, if the discharge or fill causes the loss of greater than one-tenth
acre of waters of the U.S., the permittee must submit a pre-construction notification to the USACE
containing avoidance and minimization measures and a detailed compensatory mitigation plan, and may
not proceed with construction until receipt of written authorization from the USACE.
Based on review of available resources and site reconnaissance, it appears that the unnamed tributary of
Denton Creek is a jurisdictional water of the U.S. regulated by the USACE. The proposed activity
involves lining the existing channelized portion of creek with either concrete or rip-rap over a maximum
distance of approximately 410' feet. Using an ohwm of approximately 8 feet, the proposed activity
involves a maximum of 0.075 acre (3,280 square feet) of fill in a water of the U.S. This amount is less
than the one-tenth acre notification requirement and the proposed activity should be authorized under
Nationwide Permit 14. Pre-construction coordination with the USACE is not required; however, within
30 days of project completion a letter must be submitted to the USACE detailing the amount, type, and
location of fill in waters of the U.S. and the impacted acreage.

SH 121 Improvement Project
Dallas and Denton Counties
This transmittal will document the status of our work for the three intersections involved
in our contract.
SH 121 and Denton Tap... Our field and plan reviews of this intersection indicated
that the geometric improvements to this intersection would not affect any of the
existing traffic signal controls. As a result, we are recommending that no signal
modification plans be developed for this intersection at the present time.
SH 121 and MacArthur... Our field and plan reviews indicated that the geometric
improvements to this intersection will necessitate the replacement of the detector
loops and associated ground boxes and wiring on the frontage road approaches to
the intersection. The plans submitted at this time are approximately 80% complete.
SH 121 and Lake Vista... This intersection is unsignalized and requires a full set
of traffic signal plans. The plans submitted at this time are approximately 65%
complete.
