Box 478 Coppell, Texas 75019 972-462-0022 January 22, 1998 RE: Denton Tap Road Water Line Project (# ST 94-01 WA) Dear Sir: This letter is written as a follow-up to our conversation concerning the future roadway impact fees associated with this property. I have consulted with our attorney Peter Smith, with Nichols, Jackson, Dillard, Hager & Smith, concerning the proper way to handle this matter and have been instructed that it can be easily handled by virtue of a letter from myself. My understanding of our conversation was that in signing the contracts both parties needed assurances that the future calculations of roadway impact fees will be based on fees in place as of the date of the contract, January 13, 1998. Please be advised that any calculations of roadway impact fees associated with the 22 acre commercial tract of land owned by Beal Mortgage, Inc., located at the northwest corner of Denton Tap Road and S.H. 121 will be made in accordance with fees in place as of January 13, 1998. Those fees have been established by Ordinance 95-685, amended by Ordinance 96-735, amended by Resolution 010996.2, and amended by Resolution 031296.2. The last action on current roadway impact fees was taken to Council on March 12, 1996. All fees associated with current roadway impact fees are contained in the City of Coppell Roadway Impact Fee Study Methodology and Results prepared by JBM Engineers and Planners dated October 1994. The above shall serve as a rider to the original Development Agreement as approved by City Council on January 13, 1998.
