1. City or Developer agre~s to pay Company $ in cormic~ration afCompany's agm~mentto install said strum~
lights and unde,.i~,~Ls that no construction work will begin until after Company has received full payment.
2. Company agmm to inslall, own, operate and maintain said street lights in accordance with its strut lighting agree-
ment with custon~r. However, if City or Developer fails to pay, on d~rnand, the amount indicated above, this ~upple--
mental agreement is automatically terminat~l.
3. All partita agm~ that Company will retain for its u~ and ix~t~fit th~ payment mc~iv~l h~mund®r in comid~ration af
its obligation to install mid street lights and that Company at all times hm title to, and complet~ ownership and control
of, said strum light~.
4. Company is not liable for Io~ or injury cau~cl by delay or failure to install the electric facilitim n~:~a~y to Nrv~
customer b~:auN of d~lay in mc~ivlng shipnmnts of mquimcl material, ordea or formal mqu~s of gav~mmentol
agencim, acts of God or the public enemy, inevitable accidents, tim, ~xplosiom, strikm, riots, war, or any other mum
reasonably b~ond coi~rGl of Company. If Company b proventil from installing ~uch electric faciliti~ by any of th~
above mum, Company agm~s to return to City or Developm', without interest, the entire amount of C'dy or Developer's
payment, thereby terminating this supplement and Company's obligation to provide the electric facilitim dmcrib~ immln.
