Jay Cullar is a principal of ROWAC, and along with the owner, is the responsible person for this project. He coordinates all land rights acquisition projects. When acquisition services are desired by our mutual Clients, we customarily contract in their name and Jay Cullar, and/or me, coordinate with you depending on the circumstances. By the way, ROWAC is a Women Owned Business Enterprise owned by Katherine C. Cullar, SR/WA. She is an eighteen year veteran in this profession. At age 27, Jay was the youngest person ever to be professionally designated as a Senior Member of the International Right of Way Association, two years ago. Box 478 Coppell, Texas 75019 Re: Beltline Road Improvement Project - Right of Way Land Rights Appraisal and Acquisition Proposal Dear Mr. Griffin: Thank you for inviting ROWAC to provide right of way land rights acquisition services for the referenced project. We understand the scope of professional services required for the project and will be happy to assist you in any way we can. Our staff is currently available to begin the project immediately. Following is list of the services we expect to perform in order to ensure the acquisition of the required right of way in an efficient, professional manner. Appraisal ROWAC expects to order appraisal services from Evaluation Associates on the parcels where the value of the right of way may be called into question. The fee for these services will fall into the $4,500 to $8,500 range because ROWAC will only order appraisals on those parcels where it is deemed productive. If needed, as the project progresses, Evaluation Associates will provide valuation consultation as additional services, not to exceed the upper end of the stated range. Acquisition ROWAC proposes to perform the basic services necessary functions to acquire the needed right of way for $7,500 to $8,500, plus additional services. Basic services required for this project will include ROWAC initiating and coordinating all contacts with the property owners and the coordination of negotiations, and the development and preparation of conveyance instruments to be signed by fee simple owners of record. Additional services include communications and negotiations with third parties having other interests in the same property which must be satisfied to convey unencumbered title. Such parties could include lien holders, taxing authorities, tenants, and heirs. These services will be invoiced at the hourly rate of $75. It is not possible to estimate the Mr. Ken Griffin, P.E. October 8, 1999 Page 2 amount of title curative services accurately without advance title examination. However, three to four hours title curative services per parcel can be anticipated. Title Examination If the City engages a title company qualified and experienced in divided partial interests under eminent domain, the City will be responsible for that aspect of the additional acquisition services. If the City has not established relationships with a title company, ROWAC can provided assistance. If the City is not in the habit of engaging the services of title companies and has no preference, we have experienced title examiners on staff, and can provide required title reports for the five parcels in the range of $750 to $850. Other Service Charges/Special Handling County Clerk copy fees, excessive mileage, long distance telephone charges, postage and courier fees are passed through to you at actual or nominal costs, and are estimated in the range of $400 to $600. The City would be invoiced for actual costs. County document recording fees to file records in behalf of the City will be passed through to the City. Therefore, fees related to the referenced project can be summarized as follows: Appraisal Services = $ 4,500 to $ 8,500 Acquisitions related to 5 parcels = $ 7,500 to $ 8,500 Title Research = $ 750 to $ 950 Miscellaneous fees = $ 400 to $ 600 TOTAL $13,150 to $18,550 This letter will suffice for our purposes as a professionalservices agreement and authorization to proceed work when accepted by the City. Should a more formal agreement be required, please feel free to provide it or we can provide you with one we have used in the past.
