I thought Philip knew that we were just going to include the cost of the
fence. For some reason he thought we had knocked their $20,000 down to
$14,600 without telling them. I called him last night and this morning, and
he understands. I told him that we were still going to address the other
items but we wanted to get the fence and the lights out of the way first
because they were both critical items. You should have a letter from Philip
by the end of the week with regards to the remaining items so you can
discuss it with Larry prior to our meeting on Wednesday.
I think these additional costs need to be worked out between the City and
ISl. I don't feel like it is up to me to make the decision as to whether
they get paid or not. ISI and the City need to come to an agreement as to
what they want to do. That s why I asked Philip to put together a letter
describing what they did and why so we know what they are asking money for.

I faxed Phillip the a copy of the change order yesterday so that they could
get started on the removal and replacement of the fence. I am sending him
the originals for execution today. I am also sending TXU the bighting
agreeements. Wasn't he aware that the change order was only going to
include the fence and not the additional site work? That is why I needed
the itemized cost, so we could just pull out the fence costs. I am putting
together a letter that I will send to you about the requests for the
additional costs. Larry said we will meet next Wednesday ( he is out on
Thursday) at our regularly scheduled meeting and discuss the request for
more money.

I just talked to Philip at ISl. I recommended to him that he put together a
letter describing the work that they did over by the pond, along with the
cost associated with this work, so that the City can make a decision on the
remaining $5,000 on ISl's estimate.

I got a call yesterday from Philip at ISI and apparently he is a little
"disgruntled" with regards to Change Order No. 1. Apparently he received a
copy of the change order and noticed that it only included the fence item
and the street lights. I wasn't able to get back in touch with him but I
left him a voicemail letting him know that my intention with this change
order was to address two items: the fence and the street lights. He seemed
to think that the $14,600 for the fence replacement included tree removal
and the filling of the pond. I'm still not sure what we want to do with
regards to the tree removal and the dirt placement within the pond area.
These two items total another $5000 excluding OH&P on the estimate (1-3-02)
that I received from ISl. Larry's position seems to be that they shouldn't
get paid for work they were not instructed to do. There appears to be some
discrepancy with the Contractor as to which trees were within the
right-of-way and which ones weren't. I need some direction from the City as
to how we are going to deal with this. ISI feels like they should get paid
for the work they did. I think this is an item that we need to resolve so
that we can move forward with project. Let me know if I need to fax you
another copy of the estimate dated 1-3-02 from ISI showing the costs for the
tree removal and the dirt placement.
