Change Order #1 / Traffic Control Plan
Dear Mr. Bennett:
Enclosed are three executed copies of Change Order #I for the Creekview Drive and
Freeport Parkway project. This change order addresses the removal and installation of
the steel and cable fence, and the removal of the street lights and wiring. Please sign and
return two copies to this office.
Also enclosed is the Traffic Control Plan that was submitted to this office on January 7,
2001. Following a review of the plan, it was determined that the plan does not conform
to the Texas Manual on Uniform Traffic Control Devices. Please refer to pages lA-3 and
1A-4 out of the manual (enclosed) when revising the plan for re-submittal.
The next scheduled site meeting is January 17th at 10:00 a.m. We will discuss the request
for compensation to fill the stock pond and remove trees outside of the right-of-way
along the east side of Freeport Parkway during this meeting.

Simply stated, uniformity means treating similar situations in the
same way. The use of uniform traffic control devices does not, in iteeff,
constitute uniformity, A standard device used where it is not
appropriate is as objectionable as a nonstandard device; in fact, this
may be worse, in that such misuse may result in disrespect at those
locations where the device is needed.
lA-3 Responsibility for Traffic Control Devices
The responsibility for the design, placement, operation and maintenance of
traffic control devices rests with the governmental body or official having
jurisdiction. In virtually all States, traffic control devices placed and
maintained by State and local officials are required by statute to conform to a
Stete Manuel. ~Iany Federal agencies have regulations requiring standards
in conformance with the Manual for their control device applications.
The Uniform Vehicle Cede has the foQowing provision in Section
15-I04 for the adoption of a uniform manual:
"The (State Highway Agency) shall adopt a manual and specifica-
tions for a uniform system of traffic-control devices consistent with
the provisions of this act for use upon highways within this State.
Such uniform system shall correlate with and so far as possible con-
form to the system set forth in the most recent edition of the
Manual on Uniform Traffic Control Devices for Streets and
Highways, and other standards issued or endorsed by the Federal
Highway Administrator."
Under authority granted by Congress in 1966, the Secret~'y of
Transportation has decreed that traffic control devices on all streets
and highways in each State shall be in substantial conformance with
standards issued or endorsed by the Federal Highway Admini. strator.
lA-3.1 Placement Authority
Traffic control devices shall be placed only by the authority of a
public body or official having jurisdiction, for the purpose of regulating,
warning, or guiding traffic. No traffic control device or its support shall
bear any advertising or commercial message, or any other message that
is not essential to traffic control.
Legal authority for the Department and local units of government to
erect and maintain traffic control devices, requirement of obedience to
official traffic control devices, prohibition of the display of unauthorized
signs, and prohibition of interference with official traffic control devices
are found in the "Texas Uniform Act Regulating Traffic on Highways,"
Codified as Article 6701d, Vernon's Civil Statutes.
Any unauthorized sign placed on the highway right-of-way by a
private organization or individual constitutes a public nuisance. All

unofficial and nonessential signs should be removed.
With proper authority being given, construction contractors and
public utility companies are permitted to erect construction and
maintenance signs at work sites to protect the public, equipment, and
workmen, provided that such signs conform to the standards of this
Manual.
All traffic islands shall be installed by the authority of the public
body or official having jurisdicQon. For those islands that are elemente
of street and highway design and are included in the design of the
street or highway, no specific authority is required.
Ail regulatory devices, if they are to be enforced, need to be backed
by applieable laws, ordinances, or regulations. Effective traffic control
depends not only on appropriate application of devices, but on
reasonable enforcement of regulations as well. Standards in th~e Manual
are based on that concept.
lA-4 Engineering Study Required
The decision to use a particular device at a particular location should
be made on the basis of an engineering study of the location. Thus,
while this Manual provides standards for design and applicaQon of
traffic control devices, the Manual is not a substitute for engineering
judgment. It is the intent that the provisions of tkis Manual be
standards for traffic control devices installation, but not a legal require-
ment for installation.
Qualified engineers are needed to exercise the engineering judgment
inherent in the selection of traffic control devices, just as they are
needed to locate and design the roads and streets which the devices
complement. Jurisdictions with responsibiLity for traffic control, that do
not have qualified engineers on their staffs, should seek assistance from
the State highway department, their county, a nearby large city, or a
traffic consultant.
The illustrations in this manual are not intended to set requirements
for the use of traffic control devices or pieces of equipment associated
with the use of traffic control devices or traffic control techniques. The
drawings and figures are included in this manual to illustrate examples of
the use of traffic control devices and traffic control techniques.
Engineering judgment must be used to coordinate the requirements in
the text of the manual to field conditions.
IA-5 .Meanings of "Shall," "Should," "May" and "Is Intended For Use."
In the Manual sections dealing with the design and application of traffic
eon~rol devices, the words "shall," "should," "may" and "is intended for
use" are used to describe specific conditions concerning these devices. To
clarify the meanings intended in this Manual by the use of these words, the
