Asbury Manor-CS01121701/03/2002 14:0G 2483549248 RON ~OHNSON/ROCHELLE PAGE 0! December 17, 2001 TO: Mr. Kenneth GrilTm P.E. Via Fax: 972-304-3673 FROM: Fred Phillips REG: Asbury Manor, Castlebury Court Upon discussion with Pete Henderson of Goodwin & Marshall, we have hired a vacuum .truck to clean ail the silt out from under the bridge at Asbury Manor, Since the upstream ~s concrete, there should be no further siltation. After the silt is removed we will evaluate thc lip of the drainage area to sec if some work needs to be done there to assist thc flow, With regards to the Castlebury ailcy, I agree that if it was built too narrow it should be fixed. My question is what is the City's position regarding Site Concrete, thc contractor. Is the City going to enforce Site's bond? If thc City is looking to Ryland to make these repairs, are we able to enforce Site's bond to pay for the work? As a separate issue, the City has not released the erosion control bonds on Castlcbury and Westbury Manor; beth built out for some time. In addition, Deer Run is built out, Philip Flink has requested release of these funds for many months with no response from the City. I look forward to hearing from you on these issues, and coming to mutually agreeable solutions.
