Martin, E.I.T. ~ ~) TITLE: Assistant City Engineer STAFF RECOMMENDS: Approval X Denial STAFF COMMENTS: The City has been working with Dallas CoUnty to rebuild DeForest Road from MacArthur Blvd. to the east side of Allen Drive. The basics of the agreement is for Dallas County to salvage the existing road material, prepare the subgrade to City specifications, replace with 6" compacted cement treated base and resurface with 2" asphalt overlay. The estimated cost for this project is approximately $58,436.57. Because of the classification of the roadway by Dallas County, the City is responsible for 100% of the cost. The construction will take approximately 5 to 8 days for a length of approximately 2500 feet. The County has stated that they will maintain one-way traffic during the day and allow two-way traffic in the evenings and on weekends. Staff recommends the approval of the City/County Agreement in the amount of $58,436.57 and authorizing the Mayor to sign. Director of Public Works ~ STATE OF TEXAS § COUNTY OF DALLAS § CITY/COUNTY AGREEMENT WHEREAS, the City of Coppell, Texas, hereinafter called "City", and the County of Dallas, Texas, hereinafter called "County", desire to enter into an agreement whereby the County will reconstruct DeForest Road from MacArthur Blvd. to Allen Road for a total estimated cost of $58,436.57, including a 5 % contingency charge, for this Type "E" work. This will include milling to a depth of 6" approximately 5,778 square yards of existing asphalt and base material at 1.00 a square yard and placement of 6" compacted cement treated base and resurfacing with 2" hot mix asphaltic concrete as per Attachment "A". WHEREAS, Chapter 791 of the Texas Government Code, as amended, provides authorization for local governments to enter into interlocal contracts; NOW, THEREFORE, THIS MEMORANDUM OF AGREEMENT is hereby made and entered into by the City and the County upon and for the mutual consideration stated herein; WITNESSETH; COUNTY RESPONSIBILITY 1. Salvage existing road materials, not to exceed a depth of 6" and transport to TXI. 2. Prepare subgrade to city specifications and establish line grades as directed by the city engineer. 3. Seek bids, administer contract and place cement treated base to city specifications as authorized by the city engineer. 4. Administer HMAC contract. 5. Remove and dispose of all road construction materials such as dirt and excess CTB. 6. Responsible for traffic control, lights, barricades and signs for the project. II. CITY RESPONSIBILITY 1. Inform public of the work that will be done. 2. Locate all manholes, water valves and other utilities prior to the time work will begin by the County. City to make grade adjustments on utilities if needed. 3. Relocate all mail boxes to obtain a 20' road bed. 1II. In the event the construction costs exceed the estimated cost, City and County may agree to reduce the scope of the work or seek additional funding to complete the project. Such agreement shall be in writing and authorized in a manner as provided by law. IV. It is agreed that the work will not start until this agreement has been fully executed by the City and the County. The County shall at all times exercise reasonable precautions for the safety of employees and others on or near the work and shall comply with all applicable provisions of federal, state and municipal safety laws. The safety precautions actually taken and their adequacy shall be the sole responsibility of the County. VI. The County agrees to be responsible for any liability or damages the County may suffer as a result of claims, demands, costs or judgments against the County, including workers' compensation claims, arising out of the performance of the work and services under this agreement, or arising from any accident, injury or damage, whatsoever, to any person or persons, or to the property of any person(s) or corporation(s) occurring during the performance of this agreement and caused by the sole negligence of the County, its agents, officers and/or employees. The City agrees to be responsible for any liability or damages the City may suffer as a result of claims, demands, costs or judgments against the City, including workers' compensation claims, arising out of the performance of the work and services under this agreement, or arising from any accident, injury, or damage, whatsoever, to any person or persons, or to the property of any person(s) or corporation(s) occurring during the performance of this agreement and caused by the sole negligence of the City, its agents, officers and/or employees. City and County agree that any such liability or damages as stated abOve occurring during the performance of this agreement caused by the joint or comparative negligence of their employees, agents and officers shall be determined in accordance with comparative responsibility laws of this state. Griffin, P.E., ACM/City Engineer Discussion of a potential environmental restoration, stream bank erosion and recreation cost shared feasibility study along Denton Creek between the City of Coppeli and the Corps of Engineers Date: August 19, 1996 For some time now the City of Coppell has been in contact with the Corps of Engineers concerning erosion along Denton Creek. Several funding programs within the Federal Government have been discussed. The City and the Corps of Engineers have been concentrating on one which allows the restoration of eroded areas and restoring any wetlands or environmental areas. In conjunction with this program it is possible to include associated recreational improvements. At the Council meeting staff will be providing general information on the scope as discussed with the Corps of Engineers and a preliminary cost estimate for the design. The initial program offers a 50%/50% cost split on the design; 75%/Federal - 25%/City for implementation; and 100%/City for any operation, maintenance, repair, rehabilitation or replacement associated with the project. Staff will be providing a general scope of services and preliminary costs at the Council meeting. STATE OF TEXAS COUNTY OF DALLAS SUPPLEMENTAL CITY/COUNTY AGREEMENT WHEREAS, on September 10, 1996, by Court Order No. 96-1700, the City of Coppell, Texas, hereinafter called "City," and the County of Dallas, Texas, hereinafter called "County," entered into an agreement under which the County would reconstruct DeForest Road, a Type "E" street, from MacArthur Blvd. to Allen Road, for an estimated cost of $58,436.57. This amount was placed in escrow by the City. This work has been completed for a total cost of $53,504.97, leaving a remainder of $4,931.60 in escrow. The City has indicated that it would like to extend the project to 500 feet east of Allen Road for an estimated cost of$11,111.11. This work, like that in the original project, will include milling approximately 1,111.11 square yards of existing asphalt and base material to a depth of six inches, placement of 6 inches of compacted cement treated base and resurfacing with 2 inches of hot mix asphaltic concrete. The City wishes to use the $4,931.60 remaining from the original DeForest Road project, leaving a shortfall of $6,179.51. The City has surplus funds escrowed with the County for the completed Type "B" project Bethel Road (IJ416). The City has requested that funds in the amount of $6,179.51 be transferred from the Bethel Road Project (I J416), Account No. 120-884-831-7, to the DeForest Road Project (IJ424), Account No. 120-716- 831-7, to reconstruct the additional 500 feet of roadway; and WHEREAS, Chapter 791 of the Texas Government Code, as amended, provides authorization for local governments to enter into interlocal contracts. NOW, THEREFORE, THIS MEMORANDUM OF AGREEMENT is hereby made and entered into by the City and the County upon and for the mutual consideration stated herein. WITNESSETH: City requests County to do additional work on the DeForest Road project as outlined above. The City has requested to fund this Type "E" work, at a total estimated cost orS11,111.11, through use of the funds remaining on the original DeForest Road Project ($4,931.60) and the transfer of $6,179.51 of surplus escrowed funds from the Bethel Road Project I J416.
