WA9902-CN011220SPECIAL WARRANTY DEED STATE OF TEXAS § COUNTY OF DALLAS § KNOW ALL MEN BY THESE PRESENTS That St. Joseph Village, Inc., a Texas nonprofit corporation, ("Grantor"), for and in consideration of Ten Dollars ($10.00) and other good and valuable consideration to Grantor, the receipt and sufficiency of which is hereby acknowledged, paid in hand by the City of Coppell, Texas, a Texas home-role municipality, ("Grantee") has GRANTED, SOLD AND CONVEYED, and by these presents does GRANT, SELL AND CONVEY unto Grantee all that certain lot, tract, or parcel of land situated in the County of Dallas, State of Texas, and described as follows: BEING a 4.724 acre tract of land situated in the David Meyers Survey, Abstract No. 886, in the City of Coppell, Dallas County, Texas, as more particularly described in Exhibit A attached hereto and made a part hereof. This conveyance is being made by Grantor and accepted by Grantee subject only to encumbrances and claims of record, but only to the extent that such encumbrances and claims of record are valid, existing, and, in fact, affect the Land. Except for the special warranty of title made in this Deed, Grantor makes no other representations, warranties, or covenants herein and hereby expressly disclaims all implied representations, warranties, and covenants, whether arising by operation of law, by statute, or otherwise. Ad valorem taxes for the year of this Deed have been prorated; accordingly, by its acceptance of this Deed, Grantee assumes responsibility to pay all ad valorem taxes on the Land for such year and all subsequent years. TO HAVE AND TO HOLD the Land, together with all and singular the rights and appurtenances thereto and in anywise belonging including all of Grantor's right, title and interest in and to adjacent streets, alleys and rights-of-way, subject to the encumbrances and claims of record, unto Grantee, its successors and assigns forever; and Grantor does hereby bind itself, its heirs, successors and assigns to WARRANT AND FOREVER DEFEND all and singular the Land unto Grantee, its successors and assigns against every person whomsoever lawfully claiming or to claim the same or any part thereof by, through or under Grantor but not otherwise.
