RE: Creekview Drive and Freeport Parkway
Dear Ken,
There are currently two outstanding fence issues along Creekview Drive. The first
involves the fence between Creekview Drive and the existing warehouse property
(Sra. 0+00 to Sra. 6+704-), and the second involves the fence from that point to Freeport
Parkway. The issue that has been raised a few times is whether that fence, and some of
the trees along the fence, should remain in place or be removed. The plans never clearly
stated that the fence along the South right-of-way line of Creekview was to be removed
with this project. According to the paving plans there is some grading that will be
required outside of the right-of-way and this is clearly shov, aq on the plans as thc, "Limits
of4:1 Crrading". ISI states in their letter, dated 2-15-02, that they did not bid work
outside of the right-of-xvay. This is an incorrect statement.
The issue at hand is whether the existing fence should be removed and whether ISI should
be compensated for this work. The fence along the warehouse parking should be removed
and ISI should be compensated. The removal of the rema/nder of the fence should be
reevaluated once paving is on the ground to better determine if the fence wSlt need to be
removed. Since there isn't a sidewalk on the south side of Creekview it was discussed at
one point that the "limits of grading" could begin at the back of curb and that final grading
could be dealt with ,*'hen the property to the south develops and the sidewalk is installed.
