This property was zoned PD-Highway Commercial in the mid-
1990's as part of an 87 acre tract zoned for single family and flood
plain/park uses. The initial application for this PD indicated single
family for the areas adjacent to S. H. 121 and Denton Tap Road.
However, Highway Commercial zoning was ultimately established
on this tract to provide a buffer between the residential and the high
traffic intersections.

TRANSPORTATION:
On February 17, 2000, the Planning and Zoning Commission
recommended denial of a request for a Special Use Permit for a
Burger King restaurant on a 0.92 acre tract, south of the retail Center
under construction on Denton Tap Road. This request was not
appealed to City Council.
On May 9, 2000, Council approved a detail plan for a 15,600 square-
foot retail building on approximately 2.1 acres of property along
Denton Tap Road, which is the current request area.
On December 11, 2001, Council approved a detail plan for a 6,000
square-foot Community Credit Union to be located at the southwest
comer orS. H. 121 and Denton Tap Road, which will be north of the
existing retail center containing the current area of request.
Denton Tap Road is a P6D, six-lane divided thoroughfare contained
within a 100-120 foot right-of-way. S.H. 121 will be built to
freeway standards within 450 feet of right-of-way.

COMPREHENSIVE PLAN:
The Comprehensive Plan shows the property as suitable for
regional retail uses.

The applicant desires to operate a "Donut Place" in the newly constructed
Magnolia Village retail cemer located along the west side of Denton Tap
Road, south of S. H. 121. The proposed donut shop will occupy 1,088
square feet, with 16 feet of frontage on Denton Tap Road. There will be
four, two-seat tables, with a majority of the customers being take-out. The
hours of operation are proposed to be 6 a.m. until noon, seven days a week.
This retail center has 97 parking spaces. Per Council action on February 12,
2002, this restaurant would be required to provide parking at the ratio of one
space per 100 square feet, or one space per three seats, whichever is greater.
This donut shop would require 11 spaces (based on one space per 100 square

feet -- based on one space per three seats, only 3 parking spaces would be
required). It is staff's understanding that the remainder of this retail center
has been leased to medical offices, which require parking at a ratio of one
space per 175 square feet. With this center fully leased for medical uses and
this one restaurant, there will be an excess of parking spaces.
The signage for this donut shop is based on the linear footage of the lease
space, which is 16 feet. The sign is proposed to measure 1.5 feet by 10.83
feet, which equals 16.25 square feet. Therefore, this proposed sign exceeds
the maximum permitted by 0.25 square feet. The sign is proposed to be
white or ivory individual channel letters mounted on a raceway. The color
of the raceway is not specified; however, it needs to match the color of the
brick, i.e., bronze.
RECOMMENDATION TO THE PLANNING AND ZON1NG COMMISSION:
Staff is reconunending approval subject to:
1. Reduction in size of the sign to a maximum of 16 square feet.
2. The color of the raceway shall be specified to match the color of the brick,
i.e., bronze
3. Hours of operation being 6 a.m. until noon, seven days a week.
4. The site plan, floor plan, and sign elevation, as revised in Conditions 1 and 2
above.
ALTERNATIVES: 1) Recommend approval of the request.
2) Recommend disapproval of the request
3) Recommend modification of the request
4) Take under advisement for reconsideration at a later date.
