THAT the term Grantor used herein shall be construed in the singular or plural
number as such term respectively represents one or more than one person.

known herein as GRANTOR, in consideration of the sum of Ten and no /100 Dollars ($10.00) and
other good and valuable consideration in hand paid by City of Coppell, Texas, receipt of which is
hereby acknowledged, does by these presents grant, bargain, sell and convey unto City of Coppell,
Texas, ( "GRANTEE "), the free and uninterrupted use, liberty and privilege of passage in, along,
upon and across the following described property owned by Grantor (the "easement strip ") for the
purpose of constructing and maintaining an underground drainage system across Grantor's main
tract with the right and privilege at all times, of the GRANTEE herein, its agents, employees,
workmen and representatives having ingress, egress, and regress in, along, upon and across said
premises (the "easement strip ") for the purpose of making additions to, improvements on and
repairs to said drainage system or any part thereof.
Said easement strip being described in Exhibits "A" and "B" attached hereto and made a
part hereof for all purposes.
That in consideration of the benefits above set out, Grantee will remove from the easement
strip, such fences, buildings and other obstructions as may be found upon said property. After
construction of the underground drainage system has been completed or after any entry for repairs
or maintenance, GRANTEE shall, except for removed obstructions, return the surface area of the
easement strip to its original condition as nearly as practical taking into consideration the nature of
the work being performed. GRANTORS reserve the right to use and maintain the surface of the
easement strip for purposes which will not interfere with GRANTEE'S rights hereby granted and
agree that upon completion of the underground facility and restoration of the surface, GRANTEE
shall not be obligated for future maintenance and upkeep of the surface area.
TO HAVE AND TO HOLD unto the City of Coppell, Texas, its successors or assigns for
the purposes aforesaid, the premises above described.

BEING a 1.127 acre tract of land in the City of Coppell, part of the John C. Cook Survey, Abstract No. 315
in Dallas County, Texas, and part of the tract described by instrument to Crow - Billingsley, MacArthur, Ltd.
in Volume 86029, Page 2261 and by plat in Volume 85003, Page 4009, of the Deed Records Dallas County,
Texas (D.R.D.C.T), and being more particularly described as follows:
COMMENCING at a set 1/2 -inch iron rod with a yellow plastic cap stamped "HALFF ASSOC., INC. ",
hereinafter referred to as "with cap" at the northwest comer of a tract described by instrument to Belt -Line
MacArthur, Joint Venture filed in Volume 94124, Page 00918, in D.R.D.C.T., the northeast corner of said
Crow - Billingsley, MacArthur, Ltd. tract and on the south right -of -way line of Beltline Road (variable width);
THENCE South degrees 39 minutes 47 seconds 47 West, over and across the said Crow - Billingsley,
MacArthur, Ltd. tract a distance of 44.45 feet to a set 1/2 -inch iron rod with cap for comer located at the
centerline Station 115 +59.82,offset 96.23 feet right, as defined in Public Works Project number 490 -403.1 /
91 -289 in the Project Records of Dallas County, Texas, on the existing west line of a Texas Power & Light,
Co. (T.P.& L.) power pole easement (8.75 feet wide) as recorded in Volume 4611, Page 323 of the
D.R.D.C.T. for the POINT OF BEGINNING;
THENCE South 00 degrees 30 minutes 24 seconds East, along said existing west T.P.& L. easement line a
distance of 63.49 feet to a set 1/2 inch iron rod with cap for comer,
THENCE South 00 degrees 21 minutes 51 seconds East, continuing along said existing-west T.P.& L.
easement line a distance of 756.34 feet to a point for corner,
THENCE South 89 degrees 29 minutes 36 seconds West, departing said existing west T.P.& L. easement
line a distance of 55.00 feet to point for corner,
THENCE North 00 degrees 21 minutes 51 seconds West, a distance of 756.41 feet to a set 1/2 inch iron rod
with cap for corner,
THENCE North 00 degrees 30 minutes 24 seconds West, a distance of 41.20 feet to a set 1/2 inch iron rod with

with cap for corner;
THENCE North 03 degrees 44 minutes 19 seconds East, a distance of 14.81 feet to a set 1/2 inch iron rod with
cap for corner;
THENCE South 86 degrees 15 minutes 41 seconds East, a distance of 97.70 feet to a set 1/2 inch iron rod with
