RE: Windsor Estates and DeForest Court Letter of Map Revision Submittal
Dear Mr. Griffin:
Here are the comments that I received from FEMA that I need letters from either you or your department
in order to respond to them.
1. Please submit a letter stating that your community will adopt and enforce the modified floodway.
2. In compliance with §65.6 of the National Flood Insurance Program (NFIP) regulations, the
community official responsible for floodplain management must sign and provide in writing a
statement that a property or structure, existing or proposed, to be removed from the Special Flood
Hazard Area (SFHA) meets minimum floodplain management criteria of §60.3 of the NFIP
regulations and is reasonably safe from flooding. This statement provides FEMA with assurance that
the community has reviewed all development plans and has found them to meet the following
requirements:
a. The lowest floor elevations (including basement) of all residential structures built in the area to
be removed from the SFHA are at or above the base flood ( §60.3(b)).
b. The area to be removed from the SFHA (including any existing or proposed structures) has been
determined to be "reasonably safe from flooding" ( §60.3(a)(3), §60.3(a)(4), and Technical
Bulletin 10 -01).
c. All applicable Federal and State permits have been obtained ( §60.39a)(2)).
d. All applicable local permits have been obtained. This includes a local development permit to
grade or place fill in the SFHA, and a permit for all existing or proposed construction
( §60.3(b)(1)).
e. Fill has not been placed in a floodway §60.3(d)(3) that causes a rise in the flood elevations
associated with the base flood discharge.

Dear Mr. Cadogan:
The State of Texas has no jurisdiction over the regulatory floodway of Irving or its adoption
by our community.
We have reviewed the referenced map revision request and understand the effects of the
proposed revisions to the previously defined 100 -Year Grapevine Creek Floodplain and
floodway limits, which are being proposed, within our community. The City of Irving
endorses the requested map revision and agrees to adopt and enforce the modified floodplain
and floodway limits in accordance with National Flood Insurance Program regulations, per
Section 47 -3 of the Flood Damage Prevention Ordinance (see attached).

The City of Irving certifies that the land shown on the maps submitted with the Regent
Office Center at Freeport Corporate Center better of Map Revision (LOMR) are
reasonably safe from flooding.
There are no existing structures on the site. The building outline shown on the site is for
the proposed structure. Per the plat, the proposed structure must have a finished door
elevation of 528.0.

AN ORDINANCE AMENDING SECTION 47 -3 OF CHAPTER 47 OF THE CODE OF CIVIL,
AND CRIMINAL ORDINANCES OF THE CITY OF IRVING, TEXAS, BY PROVIDING
FOR THE USE OF THE FLOOD INSURANCE STUDY FOR DALLAS COUNTY AND
INCORPORATED AREAS AND DELETING REFERENCED TO THE FLOOD BOUNDARY
FLOODWAY MAPS; AND PROVIDING A SEVERABILITY CLAUSE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF IRVING, TEXAS:
SECTION 1. That Section 47 -3 of Chapter 47 of the Code of Civil and Criminal
Ordinances of the City of Irving, Texas, is amended to read as follows:
Sec. 47 -3. Basis for establishing the areas of special flood hazard.
The areas of special flood hazard identified by the Federal Insurance Administration in a
scientific and engineering, report entitled "Flood Insurance Study, Dallas County, Texas and
Incorporated Areas" dated August 23, 2001, with accompanying flood insurance rate maps
(FIRM) and any revisions thereto either before or after the passage of this chapter are hereby
adopted by reference and declared to be a part of this chapter.
-- SECTION 2. That the terms and provisions of this ordinance shall be deemed to be
severable and that if the validity of any section, subsection, sentence, clause or phrase of this
ordinance should be declared to be invalid, the same shall not affect the validity of any other
section, subsection, sentence, clause or phrase of this ordinance.
