On the September 10 agenda there will be two items related to the Container Store and the
development of Ruby Road. .
I. The vacation of Ruby Road right-of-way west of the mid-way point in order to
straighten out the alignment of that street. That vacation will be deeded to Duke
Realty which will be incorporated into the landscaping portion of their Container
Store site, some of which may be used for parking. There will also be a very small
parcel, less than an acre of City land that will then be South of the Ruby Road
alignment. This will be a long and fairly narrow strip of land not developable and it
will also be included in the new Container Store site. The City will make a 380
grant to Duke Realty to realign Ruby Road and transfer the property.
Il. Duke Realty will contribute approximately $255,000 for the construction of
Ruby Road. They will not have any truck access on Ruby Road, but they feel this
could assist in automobile access to their site. They were not bound by any of the
City's street planning impact fee or subdivision regulations to develop Ruby Road.
The breakdown is about 34% Duke Realty and the remainder City of Coppell. This
will assist us not only in traffic for Wagon Wheel but also eventually in servicing
our industrial park.

If you have any questions about this transaction, please do not hesitate to contact
Ken Griffin or me. We will be putting details together next week with our legal
staff and Duke Realty. Discussions regarding Ruby Road have been ongoing for at
least 6 months, whether we obtained the Container Store or not.
