To whom it may concern:
I live in the Village at Cottonwood Creek Subdivision, 439 Graham Drive, lot
#15. Our property backs up to floodplain area which lies between our home and
the creek. There is a section of this area, behind lots 11 -17, that currently
belongs to the HOA as common area. What I and other homeowners would like to
do is purchase the land behind our respective properties. I have spoken to
the Planning group at Town Center, the HOA President, Gary Jernigan, and the
owners of lots 11 -17.
I am at a point where I do not know what the next step should be to proceed.
I need help comprehending what surveys, re- platting etc. need to be done as
well as determining what affect this will have on property value and TAXES.
It is my understanding, from the discussion with Planning, that the greatest
cost of all this will come from the Engineering services needed- what does
that entail? All homeowners may not wish to participate based on cost so we
all need to know what costs are involved and how they will be shared. I also
want to understand what we will be able to do with the land. I understand it
is floodplain and we cannot disrupt flow but I am hopeful that we could erect
some type of fence that will keep dogs in but will not affect water drainage.
I also had spoken to Ken Griffin some time ago about building an elevated deck
and was at an impasse because it technically was not our property so I want to
once again pursue that as an option. Another topic would be what paperwork is
needed to legally document the purchase and do we need a lawyer involved?
