EXISTING NORTHPOINT DRIVE
PAVING REPAIR AGREEMENT
This AGREEMENT is made by and between the City of Coppell, Texas, a Home
Rule City (the "CITY"), and AMBERPOINT at COPPELL, L.L.C. a Delaware limited
liability company, formerly known as Ballantyne Jack, L.L.C. ("APC"):
RECITALS
WHEREAS, APC wishes to construct Northpoint Drive from Sandy Lake Road
to its intersection with existing Northpoint Drive.
WHEREAS, APC has entered into an agreement with Glenn Thurman, Inc. to
construct the extension of Northpoint Drive
WHEREAS, APC has obtained a change order from Glenn Thurman, Inc., as
shown in Exhibit A, to make certain paving repairs, of approximately 145 square yards,
to existing Northpoint Drive.
WHEREAS, the City desires to financially participate with APC, as shown in
Exhibit B, in the repair of the existing street failure on Northpoint Drive.
NOW THEREFORE, be it resolved that the City will participate in the financial
cost of the repair of Northpoint Drive in an amount not to exceed $12,031.25.
