STAFF COMMENTS:
Currently, the City of LewisviHe has retained the services of S. J. Louis Construction, Inc.,
through the bidding process, to construct Denton Tap Road within their city limits. The
Interlocal Cooperation Act, Chapter 791 of The Texas Government Code, allows a City to
enter into an interlocal agreement with another municipality to construct improvements for
other cities using a contractor already under contract. City staff met with the City of
LewisviHe and the contractor to discuss the possibility of having S. J. Louis Construction, Inc.
construct the portion of Denton Tap Road within the City of Coppell from the north side of
S.H. 121 Bypass north to the city limit line. With the approval of this interlocal agreement,
S. J. Louis Construction, Inc. could continue their work into the City of Coppert without any
time delay. Potentially, we could have the entire portion of Denton Tap Road north of the
bypass constructed by Spring of 1998. This would eliminate two transitions from 6 lanes to
2 lanes, therefore, providing a safer roadway.
Staff recommends approval of this interlocal agreement with the City of Lewisville and will be

INTERLOCAL AGREEMENT
WHEREAS, the City of Lewisvi!le, Texas hereinafter called "Lewisville" and the
City of Coppell, Texas, hereinafter called "Coppell", wish to enter into an Agreement for
the construction of Denton Tap Road located within the city limits of the City of Coppell
north of Spur S$3, also known as S.H. 121 Bypass; and
WHEREAS, Lewisville currently has under contract with S. J. Louis Construction,
Inc. for the construction of Denton Tap Road in Lewisville; and
WHEREAS, this agreement will provide Coppert a cost benefit to extend the contract
with Lewisviile to construct Denton Tap Road in the City of Coppell; and
WHEREAS, the Interlocal Cooperation Act, Chapter 791 of the Texas Government
Code, provides authorization for any local government to contract with one or more local
governments to perform governmental functions and services under the terms of said Act;
NOW THEREFORE, this Agreement is hereby made and entered into by the Cities
of LewisviHe and Coppell for the mutul consideration stated herein:
WITNESSETH:
I.
Coppell hereby requests Lewisville to construct pursuant to the terms of this
Agreement Coppe!l's section of Denton Tap Road located north of Spur 553, also known as
S.H. 121 Bypass as indicated in the construction plans and specifications dated
approved by the City of Coppeli and incorporated herein by reference°
Coppell hereby agrees to provide funding in the estimated amount of $424,604.05
out of currently available funds in accordance with Attachment "A", for the cost of design,
construction, relocation, adjustment and betterment of certain improvements described
herein.
Coppell hereby. agrees to provide all inspection services for construction of the
portion of Denton Tap Road located in the City of Coppell.
Coppeil hereby agrees to be responsible for approval of all design changes and to
provide for any additional funding necessitated thereby, or for any increase in the quantity
of Coppe!l*s construction.
Lewisville agrees that it will not make any payment, progress or final, to the
construction contractor performing Coppell's road construction under this Agreement until
construction has been approved in writing by Coppell. Lewisville agrees that all payments
to the construction contractor shall be based on measured quantities of construction
completed as furnished to Lewisvllie by the City of Coppell City Engineer or his designated
appointee.

Lewisville agrees to prepare and execute a change order to extend comc~on of
Denton Tap in to Coppen in accordance with approved plans and specifications.
VII.
Lewisville hereby agrees that construction will not commence until thk Agreement
has been fully executed by Lewisvi!le and Coppe!l.
Lewisville hereby agrees to immediately advise Coppell of any and all design changes
which may occur during construction.
IX.
Lewisville hereby agrees to credit Coppell for any decrease in quantifies of
construction upon completion and final acceptance of the work by Coppell and to return to
Coppell all funds provided but not used for the work under this Agreement.

A. Proposal bar~ed upon Wier & Associates preliminary plans dated May & June of 1996.
B. Proposal bqsed upon commencement of construction for proposed work by December 22, 1997.
C. Start-up iteffi includes Performance, Payment & Maintenance bonds to City of Lewisvilla,
a seperate two year 50% Maintenance Bond for this proposal amount to the City of Coppell,
testing labo~itory fees for required concrete, lime subgrade and compaction tests and all staking
and engineering required for the work,
D. No permana~nt signage is included.
E, Proposal bas,'ed upon existing traffic flow / controls remaining in place as they currently
exist to allow all of the proposed work to be constructed in one move-in.
F. PropOsal is ,based upon receiving a 120 calander day time extension to our current
contract to ~complete the work.
G, Proposal is ~ased upon all excess earth material being stockpiled at a mutually agreeable location
in the existihg City of Coppall Park located south of Denton Creek end Denton Tap Road for future
use by the ;ity of Coppall,
