LI -S -1186 (Light Industrial, Special Use Permit -1186) LI- S -1186R (Light Industrial, Special Use Permit -1186 Revised) to allow a one -year extension to operate an existing temporary concrete batch plant. Potter Concrete, Ltd. 4820 Gretna Street Dallas, TX 75207 (214) 630 -2191 FAX: (214) 630 -5780 On June 12, 2001, City Council approved the initial special use permit for the temporary use of a concrete batch plant for Potter Concrete. The temporary use was limited to one year. Royal Lane is a C4D /6 four -lane divided collector built to standard in a 100' -wide right -of -way capable of accommodating a 6-lane divided thoroughfare. Creekview Drive is a C2U two-lane undivided collector built to standard within a 60' -wide right -of -way. Item 5 SURROUNDING LAND USE ZONING: North- vacant LI (Light Industrial) South vacant; LI (Light Industrial) East office/warehouse; LI (Light Industrial) West vacant; LI (Light Industrial) COMPREHENSIVE PLAN: The Comprehensive Plan shows the property as suitable for Light Industrial and showroom uses. DISCUSSION: The applicant is requesting special use permit approval for a one -year extension to continue the operation of a temporary concrete batch plant located at the west end of Creekview Drive (known as 1300 Creekview Drive). According to the Zoning Ordinance, temporary concrete batch plants are permitted for a period not to exceed 90 days. If additional time is needed beyond the permitted 90 -days, a special use permit is required. The original special use permit was granted in June of 2001, for a period of one -year and will expire in July 2002, if not extended. The applicant originally indicated to staff that four large developments in Coppell would be served from this batch plant. Those sites were: Freeport VII-Lot 2, Block A, Freeport North (611 Royal Lane) Tradepoint Industrial Park (Champion Partners) NE corner of Royal Bethel Freeport IX (Duke -Weeks Realty Corp.) North side of Bethel Road, at Freeport Parkway Extension Koll Coppell Commerce Center (Koll Development) NE corner of Freeport Parkway Burns The four projects noted above have been completed and the applicant has indicated that AmberPoint Business Park is the only Coppell development currently being served from this site. Because the multiple projects for which the permit was originally granted have since been completed, staff is unclear as to the need for the extension to serve only one site. Additionally, the two significant projects within AmberPoint are Northpoint Drive, which has been poured, and Building I, which has recently tilted up the walls. Any additional concrete work at this site or other sites could be completed under a standard 90 -day temporary approval through the Building Inspections Department. Conditions of the original special use permit required that the applicant maintain all required permits through the Texas Natural Resource Conservation Commission (TNRCC) and that a copy of all permits be provided to the City. Staff requested that documentation be provided to Item 5 the City ensuring that an extension is permitted by the TNRCC. While the applicant has provided staff with the original approval documentation, dated March 2, 2001, for a period of 120 days, and documentation that the concrete portable plant itself is permitted for a period of ten years, no documentation related specifically to this request area has been provided. Staff has consulted with the TNRCC on this matter and it has been represented to City Staff that a one -year extension for the batch plant would not be permitted by the TNRCC. Because of the numerous issues listed above, staff can not support the extension of the special use permit. The applicant has not satisfied the requirements of the original special use permit with regard to the proper TNRCC approval and the initial projects that were to be served by this location have been completed. Staff should again mention that the applicant may continue to serve Coppell and locate on specific construction sites in Coppell, for a period not to exceed 90-clays, with the required permits. RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION: Staff is recommending DENIAL of the request for an extension for the reasons listed above. ALTERNATIVES: 1) Recommend approval of the request. 2) Recommend disapproval of the request 3) Recommend modification of the request 4) Take under advisement for reconsideration at a later date. ATTACHMENTS: All conditions of the current special use permit (S -1186) remain in effect.
