You have recently provided the City four letters requesting additional compensation on the Sandy Lake Road project. You aze also requesting forty (40) additional calendaz days be added to the contract. This project has set static for approximately nine months with no contact from your office concerning the fmal payments, etc. Now within a span of four days, you have submitted four requests for additional compensation on the project and additional calendaz day time. Each of these requests aze being evaluated and will be responded to at a future date. However, I would direct your attention to your contract, the bid specifications and the North Central Texas Council of Government Specifications for information concerning the request for calendaz day extensions. Item # 1.36 of the NCTCOG Specifications states that any request for additional time should be made in writing within seven days from and after the time when any alleged cause for delay shall occur. That same section goes on to state that if it is determined that additional days are warranted then those days will only be provided for additional work in proportion to the value of the work to the original value of the contract. In addition to the NCTCOG specifications, the City of Coppell has a local amendment to the NCTCOG Specifications which states that no extension of contract time shall be allowed unless the contractor can demonstrate the delay caused an adverse impact to the critical path and that loss of time cannot be made up by revising the sequence of work of the project. No critical path information was provided with your request for additional calendaz days to be added to the project. Prior to considering your request for calendar days, a critical path should be provided showing that there was an actual delay on the project due to the inclusion of the extra work outlined in your four letters from December 26-30, 2002. If it is determined that any additional time is allowable, then again that time will be on a proportion basis of the value of the work to the value of the original contract. An example is the request of December 27, 2002 where you are requesting that 10,300 linear feet of 2" SCH 40 PVC be added back to the project in addition to twenty-eight (28) calendaz days added to the contract time. Based on the value of that work in proportion to the value of the project as a whole, the only calendaz days to be considered according to Section 1.36 of the NCTCOG Specifications would be approximately four (4) 253 PARKWAY * P.O.ROX 478 * COPPELL TX 73019 * TEL 972/462 0022 * FAX 972/304 3673 calendar days not twenty-eight (28) as indicated. Again, this is only if your critical path shows that the inclusion of that work created a delay on the project that could not be made up through sequencing of work. As stated, we are reviewing the financial aspect of your requests. But at this time, we will not allow any adjustments to the calendar day request because it was not submitted within seven days of the incident that caused the delay and because no critical path has been submitted to show that the delay caused a real delay to the project.
