I just received a fax from ISI regarding our meeting on Tuesday and it
appears that they are setting the agenda for the meeting. I discussed this
with Dan briefly and he expressed a few concerns.
We feel that by ISI setting the agenda it puts them in a position of
control. I realize that ISI requested the meeting but they City needs to
run this meeting, not ISl. Last time I talked to Larry he said that he
didn't think that the response letter had ever been sent to ISl. We think
it is imperative that ISl see this letter prior to the meeting. They need
an opportunity to see where the City stands on the issues involved otherwise
we may not get anything resolved at this meeting. I spoke with Homer at ISl
yesterday and he asked me who was going to attend and I told him I thought
that you, Ken, Larry, myself and Dan would be there. He said that the
Owner, Dennis and two other employees of ISI would be attending. There was
no indication that a lawyer would be present but if they do bring a lawyer,
we will not plan on meeting, and we recommend the City do the same. We'd
also like to get some idea as to what the City's agenda for the meeting is
going to be. We need to know if the City plans on denying all claims or if
they plan on negotiating. We need to be on the same page.
rll be out of the office for the rest of the afternoon but I wanted to send
this to you so since we are running short on time. Could you send me your
number and I will give you a call in the morning to discuss this further.
