Can you fax ISl copies of any letters you have that pertain to grading on
adjacent properties. I think ISI is finally starting to realize that they
need to start documenting things!

I had Champion sign a Letter of Permission for us to enter their property to
tie the proposed ground elevations back to the existing ground elevations.
We did not have theTexas Dugan property at the intersection of Creekview and
Freeport at that time. It was later dedicated to us and there is sufficient
room to tie back into existing grade. I prepared a site certificate for the
contractor that included the LOP and gave it to them in the pre-construction
meeting. I will get them another copy.

Did you get any kind of written permission for us to grade onto the property
on the south side of Creekview near Freeport? The issue of the fence and
the grading came up today and ISI said they would like to have written
documentation stating that they have permission to grade onto the adjacent
property. The removal of the fence is an entirely different issue.

I received the fax addressing the slope grading from both you and Philip. A
quick response from Philip who just received the letter this morning. I
showed the fax to Larry, who requested that I have you address the letter,
with a letter, before he and I approach Ken with the situation. I also
received a copy of the pay request and I passed that on to Larry.
I am working on the notes from yesterday's site meeting and I will forward
you and Philip a copy.

I just sent you a fax that I got from I$1 this afternoon. It appears as
though their tone has changed a little. I'll let you read the letter and
make your own determination. I don't agree with the way they are
approaching the fence situation. I celled Philip the other day and asked
him to call me back. I think he has faxed me twice today but hasn't called.
I think they should get some compensation for removing the fence on the
south side of Creekview because they were told to leave in place earlier and
now they are being told to remove it. Please show the letter to Larry and
let me know what he wants to do.
They also sent over a copy of their 2nd pay request. I haven't looked at it
yet. I still need to discuss Change Order #2 with Philip.
