Dear Mr. Maly:
This letter is written to authorize you to proceed with the reduction of the field notes as
described in the preliminary phase of the design. The contract specifically states that the
consultant shall obtain written acceptance of the conceptual design prior to proceeding with the
preliminary design. However, due to circumstances beyond the consultants control, approval
of the conceptual design was not granted by the City Council at the November 9th, City Council
meeting.
In an effort to allow the consultant to proceed with work that will not be affected irregardless
of the outcome of the conceptual approval by City Council, this letter is written to authorize you
to proceed with the reduction of field notes only. Any work beyond the reduction of the field
notes will require the acceptance of the conceptual design and additional written approval to
proceed with the preliminary design.
