I wanted to let you know that I did receive a letter from the Corps agreeing
with your study. The stockpond is not under the jurisdiction of the Corps.

I talked with David Madden and he wants a revised figure basically showing
the limits of the road construction project (since we only looked at the
stock pond). David wanted an the figure to have another cover letter
stating that the delineation was limited to the stock pond. I have drafted
the text below (just needs a closing). Let me know if I can help any
further.

Dear Mr. Madden:
Enclosed please find the revised figure that illustrates the limits of the
waters of the U.S. delineation for the Ruby Road project. However,
Geo-Marine, Inc. (GMI) did additional surveys within the adjacent lands to
determine that the pond was constructed in an upland area (i.e., stock
pond). GMI did not identify any waters of the U.S. within project limits of
the Ruby Road project.
