sUPPL.EMEN1'AL AGREEMEN1
THIS SUPPLEMENTAL A.GREEMENT, made as of thel~y of Al~..,~ 1987
by and between the Dallas-Fort Worth International Airport Board (successor by name
change to the Dallas-Fort Worth Regional Airport Board and herei.nafter sometimes
called the "Airport Board") and Explorer Pipeline Company (hereinafter sometimes called
"Explorer");
WITNESSETH, That.
WHEREAS, the Airport Board and ExpLorer entered into that certain Right-of-Way
Agreement (bearin!, Airport Board Agreement No. 23703-L) on the 14th day of July, L97L
(hereinafter sometines called the "Agreement"); and
WHEREAS, the Airport 80ard and Eltplorer have since supplemented the Agreement on
four occasions tl1rough four separate SuppLemental Agreements bearing numbers
respectively, 2370J-LSL through 23703-L54; and
WHEREAS, the Airport Board and Explorer desire to further supplement, amend and
modify the Agreement without waiving or abating any of the rights, duties, benefits or
obligations contained in the Agreement unless hereinafter e)CpressLy set forth;
NOW, THEREFORE, the Airport Board and Explorer, fOf and in consideration of the
covenants and corditions contained in the A.greement and those hereinafter set forth
agree as folloWS:

That the Agreement, as amended and supplemented, shall be and is hereby
incorporated herein and made a part hereof by reference.

That Exhibit A to the Agreement is hereby modified in the manner and to the
extent reflected in the attached Exhibits A-I and A-2. The pipeline relocation
accommodated by this Supplemental Agreement shall be at no cost to the Airport Board
and at no increas~,d rent to Explorer.

That this Sllpplemental A.greement constitutes all of the changes and modifications
of the Agreemert; and that except for the portions of the Agreement so changed or
modified above, the Agreement shall remain in effect in its entirety; and that the
changes and modifications as mutually agreed upon and set forth herein shaH b\1!
considered as if criginalLy set forth in the Agreement; and that in the event of any

Agreement, the langlJage of the Agreement shall prevail.
