There is a comment on the plat that reads: "Maintenance of open channel within drainage easement dedicated by this replat is the sole responsibility of the property owner, his sucessors, heirs, or assigns. This agreement shall run with the land until released by the City of Coppell, Texas, or until such time as drainage facilities are constructed in this easement that conform to the City of Coppell Subdivision Ordinance." It has been the city's policy to require property owners adjacent to drainage areas and floodplains to assume the maintenance responsibility. You indicated that the erosion is actually taking place offsite on the property to the west. You will need to obtain permission from the property owner prior to entering onto their property to do any work. If you have any questions, please feel free to contact me.
