ST9905-CS030221February 2 I, 2003 COP?ELL Ron McDearmon, Sr. Vice-President Warehouse Operations Minyard's Food Stores Inc. 777 Freeport Pkwy. P.O. Box 518 Coppell, TX 75019 RE: Bethel Road Project ST 99-05 (from the west city limits to Freeport Parkway) Dear Mr. McDearmon: This letter is written as a follow-up to our meeting concerning access to the Minyard property on the south side of Bethel Road. Included with this letter is a revised drawing of Sheets 10 and 11 of the Bethel Road plans showing a reconfigured median opening to allow for a 40-foot wide driveway, 50-feet from the west Minyard's property line. The Bethel Road project is scheduled to begin in the spring of 2004. If the revised median opening driveway location is acceptable to you please let me know so that it can be incorporated into the actual construction of the roadway. There was some discussion in our meeting about the width of the driveway and whether or not it would be a divided entrance and exit. If the driveway, as configured and shown is acceptable, then during the construction of Bethel Road the actual drive approach up to the right-of-way line can also be constructed with the Bethel Road project. Any driveway construction beyond the right-of-way line will be the responsibility of Minyard's. If you are unsure of your future plans for the driveway then we could build a curb through the driveway opening and you would be allowed to construct the drive approach and driveway at such time as you develop the remainder of your property. Once 1 have heard from you concerning the revised median opening and driveway configuration, 1 will authorize our consultant to revise the construction drawings. If you should have any questions or need additional information please feel free to contact me. If not, I look forwarding to hearing from you in the very near future. Sincerely, /3 Kenneth M.
