Dear Mr. V41k:
The Erosion and Sedimentation Control Ordinance (Ord. 91514) prohibits any person,
firm, or corporation which owns, controls, or exercises control of a property to permit a
public erosion nuisance to occur on said property. The City has not approved the erosion
control and sedimentation plans for the Self Assured Storage project and construction has
started. Erosion control measures constructed on the property are not in accordance with
the proposed erosion and sedimentation control plan and are failing to prevent erosion. It
has been determined that you are in violation of this ordinance. This letter serves as a
forty-eight (48) hour notice to correct the public erosion nuisance and to clean up and
remove the offending and burdensome sedimentation. A "stop work order" can be issued
if the site is not in compliance with this ordinance within the stated time period and fines
may be levied.
