Dear Mr. Witt:
I have been retained to represent Mr. and Mrs. Fischer with regard to a title claim relating
to their above-referenced property (the "Property"). Enclosed please find the following:
1. A copy of a Survey Plat (the "Survey") date October 24, 2000 performed by Kenneth
A. Fox, a registered professional land surveyor, Seal No. 4946;
2. A copy of an easement granting instrument dated January 25, 1974 from T. L.
Wheeler, as grantor, to Coppell Municipal Utility District No. 1, as grantee, recorded
at Volume 75142, Page 1390, Deed Records of Dallas County, Texas granting a 30
foot wide sewer line easement (the "Sewer Easement") on land in Coppell, Texas;
and
3. A copy of the Final Plat (the "Plat") of Lakewood Estates, an addition to the City
of Coppell, Texas recorded at Volume 94057, Pages 00602-00617, Plat Records of
Dallas County, Texas (the drawing of the Property is set out on Page 00603 and an
enlarged copy of that specific page is also enclosed).
The actual existence of the Sewer Easement is set forth on Pages 604-605 of the Plat in the listing
of applicable easements.

Along the western boundary of the Property, the enclosed Survey shows the following:
A 10' public utility easement granted by a document recorded at Volume 85233, Page
3291, Deed Records of Dallas County, Texas [marked in blue highlighter];
A 15' building line created by the Plat [mazked in pink highlighter]; and
A 25' sanitary sewer easement created by the instrument described in document No.
2 above [marked in yellow highlighter]. On the original blue line of the Survey, this
line is quite faint and did not copy well. For your convenience, I have redrawn it in
red ink. I have also highlighted in yellow the portion of the footprint of the house
itself and the portion of the swimming pool itself (exclusive of the decking) that are
within the purported boundary of this sanitary sewer easement.
You can also see that a smaller portion of the swimming pool and decking lie within the 15' building
line and that perhaps a portion of the fence encroaches into the 10' utility easement. A Yexy careful
reading of the enlarged version of Page 603 of the Plat indicates both the 15' building line (explicitly
shown as "15' B.L." in the middle of Lot 18 and, less clearly, the 30' sanitary sewer easement
[indicated in the upper left hand corner of Page 603]. It is, however, difficult to discern the
distinction without considerable attention to the entire plat layout.
While the encroachment over the 10' utility easement line and the 15' building setback line
are problematical, they can probably be resolved by applying for a variance from the Zoning Boazd
of Adjustment and perhaps relocating the fence. The real issue is the triangular portion of the house
[approximately 7.5' by 40' that lies within the 25' sanitary sewer easement.
While it is outside the scope of my representation, my visual inspection of the azea suggests
that the same issue exists as to Lot 1, Block E immediately to the north of the Property and may exist
as to several of the lots to the south along the Village Parkway right-of--way.
Please review this and have the appropriate staff member contact me to see if there is any
way to cure this problem. Thanks for your attention to these matters.
