Dear Mr. Hagger~
As you may recall, you and I had discussed the possibility of attending a
settlement conference, prior to litigation commencing in the above-referenced
matter. After you had obtained approval from the City Manager to attend such a
conference, and after T informed the Plaintiffs of this, it was decided that the
Plaintiffs were going to go ahead and file suit, prior to a settlement conference.
It is now my undezstanding that there was a misunderstanding between
Commonwealth Title and the Plaintiffs, concerning the settlement conference.
That is, the Plaintiff's attorney, Mr. David Apple, has informed me that he
understood through talking to the attorney for Commonwealth Tide that there
would be no settlement conference, unless and until suit was filed. This is why
he said he filed suit.
In any event, you know that we have now filed suit against the Ciry,
bringing them in as a party to this litigation.
I have recently been contacted by David Apple, and he has requested
another settlement conference be scheduled for June 25, 2001, at 12:00 P.i~4.
Please be informed that the following parties have agreed to be present at
the settlement conference:
1. Mr. and Mrs. Fischer, via telephone. They are presently in Germany.
2. Commonwealth Title;

3. The Surveyor named in the litigation.;
4. Drees Custom Homes;
5. The initial surveyor used by Drees Custom Homes.
Tl1e purpose of this letter is to request your attendance at the settlement
conference, with authority from the City to participate in a full resolution of the
disputes between the Plaintiffs and the various Defendants. Please give me a call
after you review this letter, and let me know your position.
