Griffin, P.E., City Engineer X,. ~ SUBJECT: Escrow for Property Ajacent to Sandy Lake (East of MacArthur) DATE: October 23, 1992 This memo is written in response to a letter from Mr. Lebowitz concerning his escrow requirements for property they own east of MacArthur. His letter states that he has spoken with representatives from Dallas County who state that they will be funding the project at 100%. It is true that the County will be funding the paving 100%. However, there are several aspects of the construction of Sandy Lake that the County will not be funding. Those include the design and cost for the relocation of any utility conflicts, the cost of all brick pavers including the entire intersection of MacArthur and Sandy Lake, the cost of sidewalks, the cost of the right-of-way and the cost for any other amenities requested by the City of Coppell. I am providing a copy of a memo which I sent Alan Ratlift concerning this issue on October 9, 1992. Of the items that will be funded by the City, the ones that would typically be part of a escrow are the utility relocation, the brick pavers, the sidewalks and other amenities. Pulling just the cost associated with sidewalks and incidentals out of our Pro Rata charges for a C-4D street, those would total approximately $27.50 per foot. The $ 27.50 does not include any cost for the pavers that will be installed with this project. It is quite possible that the cost to the City could be in the neighborhood of $35 to :t;40 per foot along this stretch of Sandy Lake Road. However, this is just an estimate as no plans have been developed and no cost provided from the County for the City's participation. My recommendation is that we pull just the two items out of our Pro Rata charges for a C-4D street that totaled $27.50 per foot and charge that amount at this time. Also, an open-ended escrow agreement should be executed notifying adjacent property onwers that once we have the actual cost from the County we would request that any additional funds be paid or we would reimburse any overage that we have collected. It is also my opinion that it would probably take Council approval to adjust the way we collect escrow along this stretch of Sandy Lake because of the wording in our escrow policy. Section 17(c) of Appendix A entitled "Escrow for Adjacent Streets" states that "When funds have been provided and placed in escrow with the City of Coppell for the development of a substandard road and the road is reconstructed by others at no cost to the City, the escrowed funds and accrued interest, if any, shall be refunded to the developer after completion and acceptance of the improvements. In the event that a portion of the cost is borne by the City, the difference between the developer's actual proportionate cost and the escrowed funds, including accrued interest, if any, shall be refunded to the developer after completion and acceptance of the improvements." Sieb, Director of Planning and Community Services October 23, 1992 Page 2 Again, while we are well aware that the County will be funding the paving of the street, there are other cost associated with this project that will be funded by the City and my opinion is that we should not entirely waive the escrow amount for this stretch of Sandy Lake. Coppell, TX 75019 RE: Sandy Lake Property Dear Gary: As I indicated in our telephone conversation the other day, in checking with the County Commissioner's office, we were advised that the County will fund 100% of the cost of widening and improving Sandy Lake from IH-35 west to MacArthur Blvd. Accordingly, since the property our group owns is east of MacArthur Blvd., our property will not be subject to assessment by the City of Coppell for widening and improvement of the road. I spoke with several different people in Mr. Jackson's office, and was ultimately referred to Mr. Bud Beane, who is in charge of this project for the County. Based upon these conversations, it is our understanding that our property will not be subjected to an assessment by the City for any improvements to Sandy Lake. Sincerely, Louis H. Griffin, P.E., City Engineer SUBJECT: Sandy Lake Road from MacArthur B!vd. to the Coppell City Limits DATE: October 9, 1992 On September 8, 1992, I attended a meeting with representatives from Dallas County, the City of Dallas, Shimek, Jacobs & Finklea Corporation, Sverdrup Corporation and Arredondo, Inc. Bill Jessup, of Dallas County, gave an overview of the scope of the project. Joe Carter, of SJ&F, and the City of Dallas representatives provided information concerning the existing water lines and the proposed City of Dallas water line. Arredondo, Inc will be providing the right-of-way survey and maps. The design timetable is 30 weeks, excluding review time. That should put the completion of the plans some time in late summer or early fall 1993. The county has not yet sold funds for the construction of the project, so there is no timetable on the construction. The City of Coppeil will be required to perform several aspects of the project, such as: designing the water and sanitary sewer adjustments for the existing utility lines, designing the landscaping irrigation and entering into an interlocal agreement. T. R. Kennedy, of Dallas County, stated that the interlocal agreement would not be needed until Dallas County requests funds for our participation. Our participation cost will include things such as: the design and cost for the relocation of the utilities, the cost of the brick pavers at the MacArthur/Sandy Lake intersection, the cost of the sidewalks, the cost of the right-of-way, and the cost for any other amenities requested by the City of Coppell. Dallas County will be providing funds for the actual construction of two 24 foot lanes and the necessary drainage improvements. I recently sent the typical interlocal agreement from Dallas County to Larry Jackson and he generated several areas of concern. I will continue working with Larry Jackson to formulate an agreement that the City of Coppell is comfortable with. It will then be forward to Council for approval. After the project is bid, there will be a supplemental interlocal agreement executed to cover the City's cost. I requested that the city be keep informed of the projected construction timetable so that we could begin exploring ways to fund our share of the cost.
