Solitude Drive Jackson, WY 83001 May 1, 2003 Re: West Sandy Lake Road Project # ST 99-02 Dear Mr. Ferguson: Recently the City of Coppell retained the services of Teague, Nail & Perkins, Inc. Consulting Engineers to design improvements to the section of Sandy Lake Road from S.H. 121 to Denton Tap Road. During the course of the design, it is necessary to obtain survey information from adjacent properties for design and drainage considerations. The surveyors for Teague, Nail & Perkins, Inc. have been able to obtain survey information from all properties adjacent to Sandy Lake Road, with the exception of the approximately 4]- acre tract ofland located at 900 W. Sandy Lake Road. During recent meetings concerning development, I was provided the name of a local contact, Victor Munson, to discuss gaining access to the property. Mr. Munson has suggested that I provide a Right-of- Entry form to you for your review and approval. Basically, the surveyors will enter the property, obtain necessary survey information for the proper design of the roadway and then leave the property in as good as or better condition as when they entered. Typically, there is no damage to existing fences, structures, trees, etc. during the survey phase. The Right-of-Entry form has clear and concise language in it that states that any damage caused to the property by entry will be the sole responsibility of Teague, Nail and Perkins, Inc. Also, the Right-of-Entry is very clear that the timeframe for gathering the information is either one-year from the date on the Right-of-Entry or the date of start of construction, whichever comes first. Our current anticipated construction start date is the third quarter of 2004. The project itself will widen the existing 2-lane asphalt road to a 4-lane divided concrete roadway up to Royal Lane and then a 6-lane divided concrete roadway from Royal Lane to S.H. ]21. If you are in agreement with the attached Right-of-Entry, please sign and return one original to this office so that it can be provided to the consulting engineers. If you desire any changes to the Right-of-Entry, please mark those changes and return to me. I will be more than happy to make necessary changes and provide you a revised copy for your signature. Consulting Engineers, to enter upon the approximately 41- acre tract of land located at 900 W. Sandy Lake Road, Tract 9 of the J. E. Holland Survey, Abstract 614 for purposes of obtaining necessary survey data to complete the design of Sandy Lake Road. Any damage to the property caused by entry onto the property to obtain surveying information will be the sole responsibility of Teague, Nail and Perkins, Inc, to repair. It is expressively understood that this Right-of-Entry is only for that period of time necessary to obtain data information associated with the design of Sandy Lake Road. This in no way authorizes parties to enter onto the land during the construction phase for purposes of accessing the project, storing materials, etc. This Right-of-Entry will terminate one-year from the date of this Right-of- Entry or the date of the start of construction, whichever comes first.
