For the past month I have been working with representatives of TxDOT, Vista Properties and
Coppell 200 JV, along with the City's consultant for Denton Tap Road, concerning the drainage
associated with the S.H. 121 Bypass and Denton Tap Road. TxDOT is currently designing the
bypass and it is anticipated to go to construction in 1996. Part of the design is the collection
of drainage north of the bypass and the discharge of that drainage into Denton Tap Road. Vista
Properties owns land on the east side of Denton Tap Road and Coppell 200 JV owns land on the
west side of Denton Tap Road. All of these entities, including the City, will be impacted by the
manner in which TxDOT chooses to collect and discharge the water.
After the design contract for Denton Tap Road was awarded to Weir and Associates, Ulys Lane,
of that firm began contacting TxDOT for information concerning their plans. It was discovered
that TxDOT was going to be collecting and discharging water into Denton Tap Road. This
would dictate the way the City collects the water in the future. Therefore, the City started a
series of meetings with TxDOT representatives. The response from TXDOT was that if the City
wanted to participate in the drainage at this time, then we would need to commit to the funding
at this time. Our estimates of the cost was about $600,000 (see TxDOT & Weir letters). After
initial discussions, it became apparent that drainage was going to be a major issue and potentially
a stumbling block for S.H. 121. Therefore, I scheduled several meetings between the various
representatives involved. In effect, I feel as if I have been trying to "broker" a deal between
the various entities to allow for the construction of drainage that suits all paxties involved at the
most economical cost. Them is currently an offer on the table that all parties believe is fair and
reasonable that results in a significant cost savings to all parties. The option is to collect all the
water at the intersection of Denton Tap Road and S.H. 121 and take the water eastward to an
existing 10'xl0' box culvert running from the existing south frontage road of S.H. 121 to
Denton Creek. The 10'xl0' box culvert was constructed in the 1980's by Vista Properties when
the land in question was platted in Lewisville. It has capacity to handle the water because of
recent down zonings in Lewisville for property that at one time was anticipated to be either
commercial or multi-family. All parties involved have evaluated the drainage associated with
rerouting and the various issues that could be encountered and all parties involved are
comfortable that this is the appropriate drainage direction to be taking.
Saying all the above leads us to the offer that is currently on the table to resolve the drainage
issue at this time. Because Vista Properties constructed the 10'xl0' box culvert they are
requesting to be reimbursed a portion of the cost based upon a percentage of the water being
rerouted to the box culvert. The reimbursement that Vista Properties is seeking is $125,000.
However, they are only seeking $10,000 cash up front to help offset some legal and engineering
fees they have incurred in trying to arrive at this solution. They are willing to accept offsets
against their roadway impact fee for the other $115,000 at such time as their property develops.
I have spoken with our attorney, and it is appropriate to give the offsets against the roadway
impact fee for the drainage because this will have a direct impact on the cost of construction of
Denton Tap Road, which is one of the projects included in the roadway impact fee calculations.
Vista Properties is looking for a contract directly with the City for the future offsets of the
roadway impact fee.
The second part of the solution that I am currently "brokering" is to enter into an additional
contract with Ron Fraze of Coppell 200 JV to offset half of the $115,000 by way of a pro rata
fee on each of the lots that he develops in Coppell 200 JV. In speaking with his engineer, it is
anticipated that he will develop between 500 and 600 lots on the property. If that number is
fairly accurate the City would be looking to place approximately a $100 charge upon each lot
as it develops. By doing this, the City would be in a position to collect back $57,500 from
Coppell 200 JV to offset one-half of the $115,000 that we would be providing in credits. Vista
Properties does not want to enter into a contract with Coppel 200 JV, but is seeking for the City
to basically offer the offsets and then collect our half of the money from Coppel 200 JV via a
separate contract.
Obviously, the beauty of this overall concept is that the only up front dollars is $10,000 by the
City of Coppell. Also, there will be no other monies switching hands between the City of
Coppell and Vista Properties but only offsets for future fees. Obviously, those offsets equate
to real dollars in the years that they would have been collected. Also, Coppell 200 JV is not
out any dollars except at such time as they develop their property. If all things go as planned,
the City of Coppel stands to have a drainage system constructed for a total real dollar cost of
$67,500. This is approximately 11% of the $600,000 that the State initially requested for this
drainage system to be constructed. This equates to approximately $542,500 savings on the cost
of the drainage on this project. The City would still need to construct a smaller system in
Denton Tap to collect the local drainage. That system is estimated to cost about $150,000.
Therefore, the bottom line over all projected savings with this concept is about $400,000.
In summary, I am seeking three approvals from Council:
1. To pay Vista Properties $10,000 up front cash to offset legal and engineering expenses.
2. To begin negotiations with Vista Properties to formulate a contract that would allow for
offsets against future roadway impacts fees to be incurred by Vista Properties
3. To begin negotiations with Coppell 200 JV to formulate a pro rata agreement to collect
a fee against every permit issued in the Coppell 200 JV property.
Staff is very pleased with the potential for this drainage solution to the S.H. 121/Denton Tap
drainage issue and will be available to discuss this with Council at the Council meeting.

In our meeting last Friday we reviewed the drainage patterns and possible
culvert construction options for proposed Denton Tap Road north of Denton Creek.
The improvement options were based on extending the proposed 3-6' x 5' culvert
preliminarily planned for construction by the Texas Department of Transportation. In
that meeting we indicated that extending the culvert along Denton Tap Road to Denton
Creek would involve the following:
A. There is limited horizontal spaca available between the existing roadway surface
and existing utilities on both sides of the roadway. A wide structure (20' out to
out for culvert) would be difficult to install while keeping traffic in service and
only one lane of the road would be open at the point of installation. A typical
storm drain pipe could more easily be installed and would not require closing
lanes.
B. The culvert would take up considerable space limiting opportunities foe
installation of other utilities.
The culvert extension improvements would be extremely expensive due to the
construction difficulty, and large size caused by a high downstream tailwater.
We estimated the cost to be on the order of $600,000.
D. The outlet of the structure would be near or at the Denton Creek bridge crossing,
which would increase erosion potential at this critical location.
In our meeting, I reminded you that we were of the opinion that the water course
has been diverted by adjacent property owner reclamation activities. The diversion if
honored potentially transfers substantial drainage improvement costs to the city. In our

We are providing your office with a copy of the revised proposed
alignment of Culvert S-5 for the referenced project. This plan
sheet will replace sheets #40 and #67 of the plans adequate sent
to you earlier this month. Currently, the plans adequate-depict
a culvert exiting out into a two feet by six feet flume and
cutting across Vista Mortgage Properties. This open drainage
would require a metal beam guard rail for approximately seven
hundred feet along the east side of Denton Tap Road. We feel
that there is a more feasible option.
We would like to propose for your consideration a closed drainage
system along Denton Tap Road from SH 121 Bypass to Denton Creek.
In order for this to occur, it would require your assistance in
providing the necessary design details beyond the end of our
proposed culvert. In addition, the City of Coppell would be
_~'required to provide the funding to obtain the materials and
construct the length of culvert to the Denton Creek outlet. If
you consider this as a viable option, please submit an official
written request to this office by March 20, 1995, stating that
you would be willing to provide the necessary funds prior to the
letting of the referenced project. The additional culvert length
could then be built with the referenced project.

the Comprehensive Zoning Ordinance of the City of Coppell, TX, by
amending the uses permitted in Section 30-4; "A" (Agricultural District);
amending Section 39-1 to require a building site to be established by a platted
lot and authorizing the Mayor to sign.
Gary Sieb, Director of Planning and Community Services, made a presentation to the Council.
Jim Witt also addressed the issue and felt this a more appropriate zoning for amusement use.
Mayor Morton opened the Public Hearing and asked for those persons wishing to speak against
this proposal. There were none. He then asked for those persons wishing to speak in favor of
this proposal. Again, there were none. Mayor Pro Tern Robertson moved to close the Public
Hearing and approve Ordinance No. 91500-A-91 of the Comprehensive Zoning Ordinance of
the City of Coppell, TX by amending the uses permitted in Section 30-4, "A" (Agricultural
District); amending Section 39-1 to require a building site to be established by a platted lot and
authorizing the Mayor to sign. Councilmember Sheehan seconded the motion; the motion carried
7-0 with Mayor Pro Tem Robertson and Councilmembers Alexander, Sturges, Watson, Tunnell,
Mayo and Shechart voting in favor of the motion.
