Box 478 Coppell, Texas 75019 214.462-0022 This letter is written in response to your letter of January 30th, 1996 in which you requested the time requirements for obtaining a building permit on the referenced lot to avoid having to pay the Roadway Impact Fees. Based on State law, there is a one year period for not collecting the Roadway Impact Fee if a valid permit is issued within that one year. However, that one year pertains only to the first year after the initial adoption of the Roadway Impact Fee. In this case, we adopted the Roadway Impact Fee on January 20th, 1995 and the one year expired on January 20th, 1996. You may recall at that time that the City passed Ordinance 96735, which offered clarification on the Roadway Impact Fee. Section 17-1-09 B 3 concerns plat approvals or applications for plat approvals that were filed with the City prior to January 20, 1996. The plat for your project falls in that category. The referenced section states that the Impact Fees shall be the lesser of the amount that would have been paid in escrow or the Roadway Impact Fees as set forth in Schedule 2. In this case, the escrow will be zero. Also, because the one year expired on January 20th, 1996 the Roadway Impact Fee /escrow will remain at zero regardless of when the permit is pulled for this development i.e., the one year time frame no longer has a bearing on this development.
