Thank you for your letter of May 28, 2003 directing us as to how to correct the problems on the
above noted road. During our meeting of May 27, 2003 with yourself and Mr. Hollowell, we
agreed the failure in the pavement is due to a sub grade weakness, cause unknown. You also
indicated during our meeting that you too were aware that we did not install the sub grade to the
road. It is certainly in this case a fact.
It is Driveway Maintenance's position that the rioted failure in Deforest Road is not the results of
any work we installed. We are including a copy of our contract with the Excel Group which
clearly indicates our exclusion in the sub grade work.
