THAT the term Grantor used herein shah be construed in the singular or plural
number as such term respectively represents one or more than one person.

heroin as GRANTOR, in consideration of the sum of One and no/100 Dollars ($1.00) and other
good and valuable consideration in hand paid by City of Coppell, Texas, receipt of which is
hereby acknowledged, does by these presents grant, bargain, sell and convey unto City of
Coppell, Texas, ("GRANTEE"), the free and uninterrupted use, liberty and privilege of passage
in, along, upon and across the following described property owned by GRANTOR (the
"easement") for the purpose of constructing utility improvements across GRANTOR' S main tract
with the right and privilege at all times, of the GRANTEE herein, its agents, employees,
workmen and representatives having ingress, egress, and regress in, along, upon and across said
premises (the "easement") for the purpose of making additions to, improvements on and repairs
to said utility improvements or any part thereof.
Said easement being described in Exhibits "A" and "B" attached hereto and made a part
hereof for all purposes.
That in consideration of the benefits above set out, GRANTEE will remove from the
easement, such fences, buildings and other obstructions as may be found upon said property.
After construction of the utility improvements has been completed, GRANTEE shall, except for
removed obstructions, return the surface area of the easement to its original condition as nearly
as practical taking into consideration the nature of the work being performed. GRANTORS
reserve the right to use and maintain the surface of the easement for purposes which will not
interfere with GRANTEE'S rights hereby granted and agree that upon completion of the utility
improvements and restoration of the surface, GRANTEE shall not be obligated for future
maintenance and upkeep of the surface area.
TO HAVE AND TO HOLD unto the City of Coppell, Texas, its successors or assigns
for the purposes aforesaid, the premises above described.

BEING 746 square feet of land located in the William T. Hyder Survey, Abstract
No. 1701, Dallas County, Texas, being a portion of that certain 199.915 acre
tract of land described in deed to Coppell 200 Joint Venture, recorded in
Document No. 93-R0038272 of the Real Property Records of Denton County,
Texas and being more particularly described by metes and bounds as follows:
BEGINNING at a concrete monument found in the South right-of-way line of
proposed State Highway No. 121 Bypass and the proposed West right-of-way
line of Denton-Tap Road, lying S 00°11 '38"W, 2733.79 feet from a 1/2" iron rod
foudn at the Northeast comer of said 199.91 5 acre tract described in deed

RE: Denton Tap Road Water Line Project (//ST 94-01 WA)
Dear Mr. Prine:
The City of Coppell has awarded a contract to install a 12" water line on the west side of
Denton Tap Road beginning at Parkway Blvd., north to the north side of the future State
Highway 121 Bypass. This installation of the water line will provide water service to your
properties on both the north and south side of the S.H. 121 Bypass.
The Texas Department of Transportation (TxDOT) reviewed the water line construction plans
and determined that the location of the water line at the southwest corner of the future highway
and Denton Tap Road would conflict with the proposed location of a traffic signal pole. In
order to avoid the conflict, the City will need to acquire a permanent utility easement at the
northeast comer of your property. Please see Exhibit B of the utility easement for location.
Included with this letter, is a permanent easement to be signed by you, notarized and returned
to the City of Coppell Engineering Department. The City will file the easement at the County
once it has been returned. Your cooperation in providing the permanent easement will be greatly
appreciated and will be an asset in expediting the actual construction of this project.
