Investigation Comments
This reconnaissance investigation was conducted in response to a storm water complaint taken by
the Storm Water Investigator on March 17, 2003. Ms. Deann Russey, Mr. Shane Isbell, both Storm
Water Investigators for the TCEQ-Region 4 office, and Ms. Melinda Houlihan of the SBLGA program
visited the site located at 1751 E. Beltline in Coppell, TX on May 2, 2003. The Project Manager, Mr.
Ron Valk of Assured Self Storage, was on site and was able to provide all the necessary information
to the investigator. Assured Self Storage was the only permitted operator at the time of the
investigation.
Upon arriving at 10:OOam on May 5, 2003, Ms. Russey found that the area disturbed was under, but
close to 5 acres. The area had already been cleared with the topsoil exposed, however, no silt
fencing was in place. Mr. Ron Valk explained that the silt fencing was being installed that day. Mr.
Valk stated that the Storm Water Pollution Prevention Plan (SWPPP) was at the main office. Ms.
Russey viewed the part of the SWPPP that was available, and the Best Management Practices's
(BMP's) outlined in this material were not being implemented in the time frame specified. There was
no Construction Site Notice posted anywhere on the site.
Ms. Russey explained the Areas of Concern, including:
- Construction Site Notice is not posted.
- BMP's are not being implemented prior to commencing construction activity.
In the complaint taken on March 17, 2003, it was stated that the construction project was surrounded
by a floodplain, and dirt from the project was being piled inside the floodplain's boundary. Mr. Rick
O'Dell, Construction Inspector for the City of Coppell, arrived at the site during the investigation and
further expressed concern with Ms. Russey that Assured Self Storage was not complying with city or
state regulations. Mr. O'Dell provided contact information for Mr. Paul Phy with the Irving Floodplain
Control District. Ms. Russey contacted Mr. Phy on Thursday, May 8, 2003, and found that at the
time the complaint had been called in, overburden from Assured Self Storage's construction project
was in the floodplain. This was a violation of the company's approval from the City of Coppell and
the Irving Floodplain Control District, and so the approval was revoked. Since that time, Assured
Self Storage has removed the overburden from the floodplain and has been allowed to proceed
construction.
The TCEQ will send Assured Self Storage a certified letter and attach a Summary of Investigation
Findings describing the Areas of Concern mentioned above. The company will have 30 days upon
reciept of the letter to demonstrate compliance. If it is not shown that corrective action has been
taken, these Areas of Concern will be issued as violations.
