Patrick -here is a brief synopsis of the maintenance bond requirement. I am
also including a copy from the Subdivision Ordinance of the section that
covers maintenance bonds and a copy of a generic bond form.
A maintenance bond equal to 50% of the contract value of all work
done in the City right-of--way and easements is required prior to final
acceptance. Such work would include but is not limited to: domestic
water service, irrigation meter, ADA ramps, sidewalks, drive
approaches, storm drains and sanitary sewer facilities. The bond must
be underwritten by a registered bonding agency licensed in the state of
Texas, and must be written for two years in duration, be~inninE upon
the date of final acceptance of said facilities. This bond will be due to
the Engineering Department on the date of final walk-through
inspection. Also, the as-built plans for the project must be provided
from the engineer of record at that time.
Enclosed for your review or use is a copy of a generic Maintenance
Bond form. You may use this bond form or provide one from a surety.
In either case, a licensed surety-bonding agency must seal the bond.
