Main Street Carrollton, TX 75006 RE: Flood Study for St Andrews Manor Dear Mr. Hennessey: During the Development Review Process a copy of "Study of Minor Tributary to Old Denton Creek" was presented to city staff. It's my understanding that the study was presented in lieu of a flood study for the reclamation of the floodplain that exists on the referenced site. Please be advised that prior to any work within the area contained on the St. Andrews Manor site, that is shown to be within a designated floodplain, per the most recent revision Effective Date: August 23, 2001, Map Number 4811300155 J, that a Conditional Letter of Map Revision (CLOMR) must be obtained from the Federal Emergency Management Agency. The area in question on St. Andrews Manor is shown as a floodway, and as such no increase will be allowed in the water surface. I would suggest that you obtain a copy of Ordinance J12001-952 entitled "Floodplain Management Ordinance" to determine the appropriate steps in the reclamation of the floodway on this property. Some excerpts from the Floodplain Management Ordinance are as follows: • Article 3; Section A states that the Floodplain Management Ordinance applies to all floodplain lands within the jurisdiction of the City. • Article 3, Section C states that a Floodplain Development Permit shall be required for all new construction, development and encroachment within the floodplain management areas of the City. • Article 4, Section B.11. states that prior to a Floodplain Development Permit being issued by the City that conditional approvals must be received from FEMA. The conditional approval (CLOMR) is based upon the receipt and approval by FEMA of the required technical data. 255 PARKWAY * P. O.BOX 949A t CO PPELL TX 75019 * TEL 972/462 0022 * FA% 9T 2/304 3673 • Article 4, Section C provides additional information on the Floodplain Development Permit and the type of technical data required for the submittal for a CLOMR. All flood studies submitted to the City of Coppell are reviewed by an outside consultant at a lump sum fee of $2000. Once it has met all City requirements, it is forwarded to FEMA for their review and issuance of a CLOMR. There are additional fees associated with the submittal to FEMA. This property also is within an area that is subject to a Corridor Development Permit. If the process of obtaining a Corridor Development Permit is required, then there is an additional review fee by the City along with submittals to nine cities, three counties and numerous agencies. At this time it is undecided whether or not a CDC permit will be required. My recotnmendation is to go through the initial process of a CLOMR and at that time a determination will be made on the necessity of a CDC permit. Please be advised that regulatory agencies that control the filling of wetlands must be contacted to ensure compliance with those regulations. Again, please be advised that no development can occur within the limits of the floodway, as shown on the above referenced official floodplain map, without the issuance of a CLOMR from FEMA.
