RE: North Spine Road Project
Dear Ken:
Pursuant to your request, the undersigned reviewed the revised Right-of-way
Dedication, the revised Construction Supervision Agreement, and the revised North Spine
Road Escrow Agreement.
The proposed instruments are acceptable except as noted herein. Paragraph 2 of the
Construction Supervision Agreement provides that the Trust and City shaJ] agree upon the
respective pOrtiOnS Of any increased cost of the project to be paid. If the cost of the project
is allocated on a 70:30 basis, any increased cost to be paid should be on the same or other
basis agreed upon now rather than subject to later negotiation. Atso, we assvine that the
City has or will award the contract for the project pursuant to competitive bidding. Finally,
we question the need for the City to escrow its portion of the cost of the project since the
City has or will contract for and supentise the construction.
