WHEREAS, the City of LewisviHe, Texas hereinafter called "Lewisville" and the
City of Coppert, Texas, hereinafter called "Coppert", wish to enter into an Agreement for
the construction of Denton Tap Road located within the city limits of the City of Coppei]s
north of Spur 553, also known as S.H. 121 Bypass; and
WHEREAS, Lewisville curren~y has under contract with S.J. I ~),mis Con~ructioq,
Inc. for the construction of Denton Tap Road in LewisviHe; and
VVHEREAS, th|.~ agreement will provide Coppert a cost benefit to extend the contract
with LewisviHe to construct Denton Tap Road in the City of Coppell; and
WHEREAS, the Interlocal Cooperation Act, Chapter 791 of the Texas Government
Code, provides authorization for any local government to contract with one or more local
governments to perform governmental functions and services under the terms of said Act;
NOW THEREFORE, this Agreement is hereby made and entered into by the Cities
of Lewisville and Coppert for the mutual consideration stated herein:
WITNF-~ETH:
I.
Coppall hereby requests Lewisville to construct pursuant to the terms of this
Agreement Coppelrs section of Denton Tap Road located north of Spur 553, also known as
S.H. 121 Bypass as indicated in the construction plans and specifications dated
approved by the City of Coppell and incorporated herein by reference.
Coppell hereby agrees to provide funding in the estimated amount of $ 4~604.05
out of curren~y available funds in accordance with Attachment "A ", for the cost of design,
construction, relocafion, adjustment and betterment of certain improvements described
herein.
Coppeil hereby. agrees to provide all impection services for construction'of the
portion of Denton Tap Road located in the City of Coppe!l.
Coppert hereby agrees to be responsible for approval of all design changes and to
provide for any additional funding necessitated thereby, or for any increase in the quantity
of CoppeH's construction.
LewisviHe agrees that it will not make any payment, progress or final, to the
construction contractor performing Coppdl's road construction under thi.~ Agreement until
construction has been approved in writing by CoppeA1. Lewisville agrees that all payments
to the construction contractor shall be based on measured quantifies of construction
completed as furnished to Lewisvi!le by the City of Coppell City Engineer or his designated
appointee.
LewisviHe agrees to prepare and execute a change order to extend construction of
Denton Tap in to Coppert in accordance with approved plans and specifications.
LewisviHe hereby agrees that construction will not commence until this Agreement
has been fully executed by Lewisville and Coppert.
LewisviHe hereby agrees to immediately advise Coppert of any and all design changes
which may occur during construction.
IX.
LewisviHe hereby agrees to credit Coppell for any decrease in quantities of
construction upon completion and final acceptance of the work by Coppell and to return to
Coppert all funds provided but not used for the work under this Agreement.

A. Proposal ba~d upon Wier & Associates preliminary plans dated May & June of 1996.
B. Proposal bqsed upon commencement of construction for proposed work by December 22, 1997.
C. Staff-up iterh includes Performance, Payment & Maintenance bonds to City of Lewisvilla,
a separate ~wo year 50% Maintenance Bond for this proposal amount to the City of Coppall,
testing laboritory fees for required concrete, lime subgrade and compaction tests and all staking
and engineering required for the work.
D. No permanent signage is included.
E Proposal ba~sed upon existing traffic flow / controls remaining in place as they currently
exist to allo~v all o1' the proposed work to be constructed in one move-in.
F. Proposal is ~ased upon receiving a 120 calander day time extension to our current
contract to ~;omplete the work.
G. Proposal is ,~ased upon all excess earth material being stockpiled at a mutually agreeable location
in the existing City of Coppall Park located south of Denton Creek and Denton Tap Road for futur~
