Actually that's good news. It gives us a better argument. Do we have a
reason why the architectural team didn't submit on time?
I ask this because our taking this to TDLR is likely to draw their attention
to this issue. This could get the architect in trouble.
Anyway, let's schedule our "event" so we can move this thing forward.

That is misleading. The plans were submitted after the project was
complete. Nearing the end of construction, I asked our consultant about
ADA reviews and found out that the plans were never submitted. I then
asked them to submit and here we are. Again the comments were generated
after the construction. The project was started in August 1998.

Sorry I didn't get back to you yesterday. I was digging into the
history of
the project, pulled the file, and found some information that will
effect
the variance plan we discussed.
This project will be considered "new construction" by TDLR. With new
construction projects TDLR is a LOT less apt to offer many breaks from
what
is required. More importantly, the plan review was done by them and the
slope issue was addressed then. The way they see this program, plans
are
submitted, comments are made, plans are changed in accordance with the
comments, project is built and if comments were followed it will be
built

There were comments made on the plan review regarding the slopes. To go
back to them at this point will be a very difficult thing to do. The
first
question they will ask is "If compliant slopes were known to be a
problem in
July, 2001, why didn't you come discuss it with us before you built it?
I'm
afraid there will be very little sympathy and we'll have an uphill
battle.
The architect that got the plan review comments should have addressed
all of
this at that time. TDLR's response will be "Too bad, fix it".
So, at this point I think we need to walk the project, like you
recommended,
fix everything that can be fixed so it fully complies and beg for mercy
for
the most difficult, most expensive areas using the public rights of way
information as necessary. I've attached the public rights of way report
for
you to review if you have time. If not, I'm almost to the point of
memorizing it.
Let's get our plan on the schedule starting, hopefully, early one
morning
before it gets too hot.
