County of Dalins, State of Texas, described in EXHIBIT "A", "B", AND "C"
made for a more particular description of said property;
TO HAVE AND TO HOLD the same perpetually to the City of Irvin~ its en~essurs
endassi~ns~togetherwiththeri~tandp~ivi~egeatenyandai~rimes~entarsaidpremises~c~any
par thereoC for the purpose of cemu~c~ng and maintaining said ~mtar main, and rn~'i-2
conherons therewith; all upon the con&don that the City of Irving will at all times, ~ doing
any work in coniclion with the coastsu~on or repair of said water main, restore said premises to
the condition in which same were found before such work was -~_-re. zken. Said ariasire
easement shall not bo used by any entity either in whole or pan without ~ ~ express
penniesion of the Direnor of public Works, City of lning. City shall have right to enter premises
at any time, in addition to the purposes stated above for the purposes of clearing said easement of
any improvements, trees, vegetation, or other obs~ruaicus or poesfole obsm~aas as deemed
necessary by Director of P~blic Works, City of Irving to protea the integrity of the water main. In
the event removal becomes necessary of unauthorized improveinertia phced on the easemere by
Grantor, Grantor shall bear rsusonablc costs for such removal.
Reserving, bov~vcr. to grantor the dghi to use said easement ~or purposes of landsuaping,
paved parking lots, recreational uses, public right-of-ways or other uses if approv~:l in wdt~ by
the Director of Public Works. City of Ir~ng.
in the event that the property. encumbered by this F_~clusive Water Main Easenent is
dedicated and accepted ns public right-of-way either in whole or in part, that poaion of the
exclusive easement ~hall become null and void and no longer in effect. hi on way ~r shall the
dedication and ar. eptance of public right-of-way over a portion of this easem~t nulli~ or hi any
way affect the enforcement of the remainder of the easurne~t not dedi~:_~!_ and accepted as public
right-of-way.
Grantor also hereby grants temporary. constnwtion easement ns described in Exhibit "A",
"8", and "C' for the puqx>ses of constructing the water mare. Said temporary. easement shall
automatically terminate after twenty-four (24) month~ or the completion ofrlz projeer, whichever
oncur~ first. Said temporary,, easement shall be used, should the contractor find it necessary, for the
swragc of men/and or equipment durm~t constriction.

BEING a parcel of land for permanent water main easement of variable width located in the S. A. & M. G.
Survey, Abstract No. 1442, Dallas County, Texas, and being part of a 9.7413-acre tract of land conveyed to
the City of Coppell, Texas, by a deed now of record in Volume 95007, Page 1993 of the Land Records of
Dallas County, Texas, said permanent easement being more particularly described as follows:
BEGINNING at an iron rod found in the northeast comer of said City of Coppell meet, said iron rod also
being the southeast comer of a tract of land conveyed to the Carrollton-Farmers Branch Independent
School District by a deed now of record in Volume 89075, Page 274 of the Land Records of Dallas County,
Texas, also being in the east line of a 30-foot sanitary sewer easement now of record in Volume 75142,
