Re: High Grass in Medians on Denton Tap Road
Councilman Cowman's Comment - 4/10/90 City
Council Meeting
I contacted John Karlsruher, Ginn, Inc. who said that L.H.
Lacy, the contractor for the Denton Tap Road project, was
not willing to undertake mowing of the medians because
it is not in their contract. I informed John to contact
L.H. Lacy, and advise them that the mowing of the medians
is incidental to their contract. Their contract does state
that they must comply with all laws and ordinances, and
our fire Marshall is prepared to inform the contractor
tha-,: they are in violation of our high weed and grass
ordinance. Upon issuance of such a letter, the contractor
will have to be in compliance within 10 days or be cited.
This is all based on the fact that the City has not accepted
the project yet.
Additionally, a memo with a copy of the ordinance has been
sent to John for official record. John has verbally made
L.H. Lacy aware of this.

RC: High Grass - Denton Tap Medians
As we have discussed, please inform L. 11. Lacy, the Contractor for
the Denton Tap Road Project that the grass in the medians is in
violation of City Code Sec. 9 -8-1. The City Fire Marshal is
prepared to take action on this matter.
Since the project has not been accepted by the City, the mowing of
grass is incidental to the contract in that he must comply with
all laws, ordinances and regulations whether city, state or federal
according to his contract.
Please have L. H. Lacy contact me in order to avoid any unnecessary
proceedings.

ARTICLE 9 - 8 WEEDS, URUSH AND UNWHOLESOME MATTER
Sec. 9 -8 - -1 WEEDS, BRUSH, LTC_, OVL•'R 12" HIGH
It shall be unlawful for any person owning, claiming, occupying or having
Supervision or control of any real property, occupied or unoccupied, within
the corporate limits of the City, to permit woods, brush or any
objectionable or unsightly matter to grow to a greater height than twelve
(12) inches upon any such real property within one hundred fifty (150)
feet of any property line. All vegetation, not regularly cultivated, and
which exceeds twelve (12) inches in height shall be presumed to be
objectionable and unsightly matter. (Ord. 281)
Sec. 9 -3 -2 DUTY OF PROPERTY OWNL K 'CO CUT AND RLMOVL
WEEDS, BRUSH AND UNSIGHTLY MATPL'R
It shalt be the duly of any person owning, claiming, occupying or having
supervision or control of any real property within the corporate limits of
the city, occupied or unoccupied, to cut and /or remove all weeds, brush
and other objectionable or unsightly mutter from such property and to a
point fifteen (15) feet outside any such property line that is adjacent to
a street or alley right -of -way as often as may be necessary to comply
with the preceding section; provided, that the cutting and removing of
Sarno at least once every thirty (30) days shall be deemed compliance
with this Article. (Ord. 87 -334)
Sec. 9 -8 -3 DUTY OF PROPERTY OWNER TO REMOVE STAGNANT
WATER, RUBBISH, TRASH, CARRION OR OTHER
IMPURE OR UNWHOLESOME MATTER
A. It shall be the duty of any person owning, claiming, occupying or
having supervision or control of any real property, occupied or
unoccupied, within the corporate limits of the City, to keep such
property free from stagnant water, rubbish, trash, filth, carrion or
other impure or unwholesome matter of any kind, and to keep the
Sidewalks in front of this property free and clear of the same,
and, to fill up, drain or regradc any lots, ground or yards which
shall be unwholesome or have stagnant water therein, and, to
cleanse and disinfect any house, building, establishment, lot, yard
or ground from rubbish, trash, filth, carrion or other impure or
unwholesome matter of any kind. (Ord. 281)
L'. Rubbish, as that term is used in this Article, shall include but not
be limited to the debris left upon properties after any building or
other structures on such properties have been:
1. Destroyed by fire or other calamity and the same not restored
to its original or better condition or removed from the

Re: Denton Tap Road Improvements
Dear Mr. Balch:
I am transmitting herewith a copy of the City of Coppell's notice
regarding a violation of City Code Section 9 -8 -1 by L. H. Lacy
Company. It is the City of Coppell's interpretation of this
ordinance which prompts them to require that L. H. Lacy Company
comply with the ordinance as it pertains to mowing and
maintaining the grass in the project medians until the project
has been accepted by the City. We suggest that you mow and
maintain the medians until the project has been accepted by the
City as complete.
The City mowed areas with poor visibility attributable to high
grass as an emergency measure yesterday. They expect L. 11. Lacy
Company to complete the mowing as soon as possible.
