Dear Mr. Ratliff:
I z~n in receipt of your letter of June 30th with the acccm~panying corre-
spondence. I wanted to write this letter to em~ize a point which was
not discussed in the correspondence from [~mas and Nettleton and its
representat ives.
It is my .~ory that Izmnas and Nettleton agreed before the Texas Water
C~,,,ission to construct and leave in place a check dam at the confluence
of the old Denton Creek Channel and the flood relief channel. The purpose
of this check dam was to maintain normal water flows in Denton Creek. The
purpose of the study to be conducted one year after the ccl~pletion, was to
see if the check dam was, in fact, working as planned, mile it is im-
portant that the study is to be prepared; it is n~ach more fundamentally
important that the check dam has apparently been L~,~ed, after being in
place for over two years during the construction period. Any study
conducted at this time w~uld not reflect the real impact of the syst~mm
approved by the Texas Water Co,,,ission because that system has been
altered just prior to the study being c~,,,enced. It see~s to me that the
city _r~cds to Get an answer from the Denton County Levee Imp~cye~ment
District No. 1, as to when the check dam is going to be replaced and the
study should take plaee after it is replaced.
