RE: Bethel School Road Project #ST02-02
Dear Mr. Caudill:
The City of Coppell has received your request for suspension of Calendar Days on the referenced project dated
November 21, 2003. Work began on the project on November 17, 2003 and by the end of that week, on November
21, 2003, it was noted that there were several gas service lines in conflict with the subgrade paving along the south
side of Bethel School Road. Your letter requested that the time be suspended until the utility company had cleared
all lines in conflict.
In the contract documents under Instruction to Bidder, paragraph 8.3 states: "Extension of the contract time shall
be based on a Change Order or written amendment as specified on Item 1.36 of the General Provisions." The
General Provisions referenced here are the North Central Texas Council of Governments General Provisions.
Section 3 entitled "Standard Specifications Supplemental Conditions, in your contract revises 1.36 to state: "No
extension of the contract time shall be allowed unless the contractor can demonstrate the delay caused an adverse
impact to the critical path and that loss of time cannot be made up by revising the sequence of the work of the
project."
To this date, no information has been provided showing that the critical path has been adversely impacted by the
gas services being uncovered during the week of November 17'h, 2003. It is my understanding that there is still
substantial amount of work that can take place on the postal facility property in regard to driveway configuration,
prep and construction.
In conversations with TXU Gas, it has been conveyed to me that the relocations of the gas service lines will begin
on December 2, 2003. I am unsure of the actual time that it will take for the relocations to be completed by TXU
Gas. However, until such time as a critical path on the project has been provided showing that the gas lines have
caused an adverse impact which cannot be made up through revising the sequence of work, the City cannot
approve any extension of contract time on the project nor suspend the contract Calendar Days.
As of the date of this letter, December 1, 2003, 15 Calendar Days have been counted against this project. The
Calendar Days that you bid on this project was 75, so therefore, there still remains 60 Calendar Days to complete
the work.
If you have any questions or need any additional clarification please feel free to give me a call. If you do have a
critical path that shows an adverse impact based on the utility conflicts, please provide that to this office.
