Box 478 Coppell, TX 75019 Dear Mr. Proctor: I am writing this letter for the expressed purpose of providing the Coppell city officials with certain facts regarding my long standing litigation with the Triland Development Co. My contract was breeched according to jury findings in the 162nd District Court in July 1985, Dallas, Texas. This case is now being appealed to the court of appeals for the Fifth Supreme Judicial District, Dallas, Texas. The Coppell acting city attorney advised the Coppell city council not to get involved in a private contract dispute. He did not tell them to get involved in which they did. Triland could not have changed "The Lakes of Coppell" plans without the city's approval. This the city gave. I have appeared before the Coppell city council on many occasions to protest the city allowing Triland variances, platt approvals, zoning changes, road changes, and not accomplishing projects promised to council such as: 1. Completion of the cul-de-sac on Warren Court. 2. Utilities are not on my property as agreed to. more than 100 yards from my property line. The sewer line is I have not received a deeded easement for the 50 foot right-of-way that will connect the northwest corner of my property to Allen Road that Triland promised Councilman Ware in open council meeting. In my opinion these deals made by city fathers and not accomplished have the effect of making the city of Coppell directly liable for each and every offense. Mr. Frank Proctor Page 2 May 29, 1986 I respectfully request that until that time, all promises made regarding the lakes project are complied with to the letter, the city government of Coppell grant no approval for any subsequent request made by this group of people whomever they may be.
