KNOW ALL MEN BY THESE PRESENTS
THAT the term Grantor used herein shall be construed in the singular or plural
number as such term respectively represents one or more than one person.

known herein as GRANTDR, in consideration of the sum of Ten and No/100 Dollars ($10.00) and
other good and valuable consideration in hand paid by City of Coppell, Texas, receipt of which is
hereby acknowledged, does by these presents grant, bargain, sell and convey unto City of Coppell,
Texas, ("GRANTEE"), the free and uninterrupted use, liberty and privilege of passage in, along,
upon and across the following described property owned by Grantor (the "Easement Strip") for the
purpose of constructing and maintaining an underground sanitary sewer system across Grantor's
main tract with the right and privilege at all times, of the GRANTEE herein, its agents, employees,
workmen and representatives having ingress, egress, and regress in, along, upon and across said
Easement Strip for the purpose of making additions to, improvements on and repairs to said sanitary
sewer system or any part thereof.
Said Easement Strip being described in Exhibits "A" and "B" attached hereto and made a
part hereof for all purposes.
That in consideration of the benefits above set out, Grantee will remove from the Easement
Strip, such fences, buildings and other obstructions as may be found upon said property. After
construction of the underground sanitary sewer system has been completed or after any entry for
repairs or maintenance, GRANTEE shall, except for removed obstructions, return the surface area
of the Easement Strip to its original condition as nearly as practical taking into consideration the
nature of the work being perforraed. GRANTOR reserves the right to use and maintain the surface
of the Easement Strip for purposes which will not interfere with GRANTEES rights hereby granted
and agree that upon completion of the underground facility and restoration of the surface,
GRANTEE shall not be obligated for future maintenance and upkeep of the surface area.
TO HAVE AND TO HOLD unto the City of Coppell, Texas, it successors or assigns for
the purposes aforesaid, the premises above described.

BEING a 0.1248 acre tract of land in the City of Coppell, Dallas County, Texas, and being situated
in the W. Perry Survey, Abstract Number 1152, and being a part of a 2.340 acre tract of land
described in Foreclosure Sale Deed to Steve Kimbml, Adrian F. Moore and Johnny J.E. Thompson,
recorded in Volume 2002064, Page 6161, Deed Records of Dallas County, Texas, (D.R.D.C.T.),
and being more particularly described as follows:
BEGINNING at a 1/2-inch iron rod with a yellow plastic cap stamped Halff Assoc., Inc., (hereafter
referred to as "with cap") set at the southeast comer of said 2.340 acre tract, said point being in the
west right-of-way line of Riverview Drive (a variable width right-of way, being 70 feet wide at this
point), and being on the north line of Riverview Estates, an addition to the City of Coppell, Dallas
County, Texas, as recorded in Volume 97174, Page 5346, Map Records of Dallas County, Texas;
TH]ENCE North 89 degrees 47 minutes 00 seconds West, departing said west right-of-way line and
along a north line of said Riverview Estates, a distance of 97.50 feet to a 1/2-inch iron rod with cap
set for comer;
THIENCE North 00 degrees 13 minutes 00 seconds East, departing said north line, a distance of
20.00 feet to a I/2-inch iron rod with cap set for comer for comer;
THENCE South 89 degrees 47 minutes 00 seconds East, a distance of 77.50 feet to a 1/2-inch iron
rod with cap set for comer;
THENCE North 00 degrees 13 minutes 00 seconds East, a distance of 110.11 feet to a 1/2-inch iron
rod with cap set for comer;
THENCE North 44 degrees 56 minutes 44 seconds West, a distance of 52.00 feet to a 1/2-inch iron
rod with cap set for comer;
THENCE North 00 degrees 13 minutes 00 seconds East, a distance of 12.11 feet to a 1/2-inch iron
rod with cap set for comer in the south line of a variable width Right-of-way easement to the City
of Coppell, as recorded in Volume 97076, Page 2760, D.R.D.C.T.;
THENCE North 89 degrees 59 minutes 27 seconds East along said Right-of-way line, a distance of
20.00 feet to a 1/2-inch iron rod with cap set for comer;
THENCE South 00 degrees 13 minutes 00 seconds West, departing said Right-of-way line, a
distance of 3.87 feet to a 1/2-inch iron rod with cap set for comer;
THENCE South 44 degrees 56 minutes 44 seconds East, a distance of 52.00 feet to a 1/2-inch iron
rod with cap set for comer on said west right-of-way line of Riverview Drive;
