Director of Engineering and public works City of Coppell, Thank you for your letter informing me and my neighbors about thc 1999 ordinance that may conflict with the recent license approved by the city. At, er reading the letter, I did some rough measttremen~s. As I have drawn in the diagram attached, there is a stone wall about 15 feet from the Deforest road_ The proposed extension of my back yard (The shaded box) is at least another 13 feet from the wall. Therefore 1 think there is no apparent conflict between the 1999 ordinance and the recent license to my property even if the 1999 ordinance is still valid. If I understand correctly, the current dispute does affect my plan to extend my fence around my back yard for 10 feet since the work area is out of the l0 feet disputed right-of-way. I have been prepared this project for quite a while and desire to carry on the work as soon as possible since the weather is very pleasant. If there is any different opinion, please let me know at your e~liest convenience! The confusion concerning the excess 10 feet arose because in 2001 the developer for Windsor Estates filed an incorrect plat. The plat filed in 2001 show~ the 10 feet as excess right-of-way However, the exhibits attached to the 1999 ordinance approved by Council clearly show that the 10 feet of excess right-of-way was part of the landscape area of Windsor Estates. I have contacted our attorney's office for an opinion on this situation. At this poim I honestly do not know whether the 1999 ordinance supercedes the license agreement recently approved by Council in 2003 or if the filing of an incorrect plat in 2001 negates the 1999 ordinance. Needless to say, this is a complicated matter at this time, therefore I have requested that the Building Inspections Department not issue any permits for fences or work in the disputed area. I apologize for any inconvenience this may cause you at this time, however umil this matter is resolved, no work can be permitted within the 10 feet of disputed right-of-way of Deforest Road Sincerely, Kenneth M.
